(Photo by Win McNamee\/Getty Images) <\/figcaption><\/figure>\n<\/p><\/div>\n<\/header>\n<div class=\"single-article__content\">\n<div class=\"single-article__content-inner has-drop-cap\"> <html readability=\"40.942714005663\"><body readability=\"84.030780243379\"><\/p>\n<p>The U.S. spy chief on Wednesday published its policies for how intelligence agencies collect and use information from data brokers, but a prominent Hill critic says the guidance doesn\u2019t address a key point about what kind of information it can or can\u2019t obtain.<\/p>\n<p>The \u201c<a href=\"https:\/\/www.dni.gov\/files\/ODNI\/documents\/CAI\/Commercially-Available-Information-Framework-May2024.pdf\">Policy Framework for Commercially Available Information,\u201d<\/a> or CAI, released by the Office of the Director of National Intelligence (ODNI), describes the fundamental way the intelligence community will approach such data, when something is sensitive enough to warrant additional protections and more. It follows <a href=\"https:\/\/cyberscoop.com\/congressional-privacy-bill-looks-to-rein-in-data-brokers\/\">a flurry<\/a> of <a href=\"https:\/\/cyberscoop.com\/proposed-data-broker-regulations-draw-industry-pushback-on-anonymized-data-exceptions-bulk-thresholds\/\">government activity<\/a> designed <a href=\"https:\/\/cyberscoop.com\/house-passes-4th-amendment-is-not-for-sale-act\/\">to address<\/a> how <a href=\"https:\/\/cyberscoop.com\/house-passed-data-privacy-bill-doesnt-thrill-privacy-groups\/\">feds use information<\/a> from companies that <a href=\"https:\/\/cyberscoop.com\/data-broker-executive-order-china\/\">harvest personal information<\/a> on people and then sell it.<\/p>\n<p>\u201cIn keeping with my commitment to share as much as possible about the IC\u2019s activities, we are sharing this framework which provides effective governance for the IC\u2019s handling of CAI while also protecting Americans\u2019 privacy and civil liberties,\u201d Director of National Intelligence Avril Haines said in a statement.<\/p>\n<p>Sen. Ron Wyden, D-Ore., who has been at the forefront of <a href=\"https:\/\/www.wyden.senate.gov\/news\/press-releases\/wyden-releases-documents-confirming-the-nsa-buys-americans-internet-browsing-records-calls-on-intelligence-community-to-stop-buying-us-data-obtained-unlawfully-from-data-brokers-violating-recent-ftc-order\">scrutinizing intelligence agency use of data brokers<\/a>, offered both criticism and praise of the document.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>\u201cThe framework\u2019s absence of clear rules about what commercially available information can and cannot be purchased by the intelligence community reinforces the need for Congress to pass legislation protecting the rights of Americans,\u201d Wyden said in a statement. \u201cThe DNI\u2019s framework is nonetheless an important step forward in starting to bring the intelligence community under a set of principles and policies, and in documenting all the various programs so that they can be overseen.\u201d<\/p>\n<p>What it does address are definitions the intelligence community will employ and principles it will adhere to, such as saying that privacy and civil liberties \u201cshall be integral considerations, timely considered\u201d in the use of information purchased from data brokers. It states that it won\u2019t be used to discriminate against anyone based on things like race or gender, that agencies will assess the original source of the data and its quality and that members of the intelligence community will periodically review implementation of privacy safeguards.<\/p>\n<p>Additional scrutiny of using the data would come into play for \u201csensitive CAI,\u201d such as \u201cdata that captures personal attributes, conditions, or identifiers that are traceable to one or more specific U.S. persons, either through the dataset itself or by correlating the dataset with other available information.\u201d<\/p>\n<p>In <a href=\"https:\/\/www.dni.gov\/files\/ODNI\/documents\/CAI\/Commercially-Available-Information-Statement-May2024.pdf\">a statement accompanying the framework<\/a>, the ODNI emphasized the need to obtain the data, citing the use of commercial imagery to share perspective with allies and warn of Russian plans to invade Ukraine.<\/p>\n<p>\u201cCAI is invaluable to our work,\u201d the statement reads. \u201cAt the same time, we acknowledge that CAI raises new concerns, and we are committed to engaging in our work in a way that is protective of Americans\u2019 privacy and civil liberties.\u201d<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>Spokespeople for the chairmen of the House and Senate intelligence committees didn\u2019t immediately respond to requests for comment on the framework.<\/p>\n<p>Wyden said he\u2019d be paying attention to how the intelligence community implements the guidance.<\/p>\n<p>\u201cI intend to watchdog this process intently, to ensure that every element of the intelligence community implements the framework, that Congress is fully informed of all these programs, and that the executive branch finally delivers transparency about its acquisition of commercially available data,\u201d he said.<\/p>\n<p>A privacy advocacy group shared Wyden\u2019s mixed verdict on the framework.<\/p>\n<p>\u201cFor too long, government agencies have tried to buy their way around our constitutional and statutory protections using taxpayer money.
