(Photo by Chip Somodevilla\/Getty Images) <\/figcaption><\/figure>\n<\/p><\/div>\n<\/header>\n<div class=\"single-article__content\">\n<div class=\"single-article__content-inner has-drop-cap\"> <html readability=\"35.292183031459\"><body readability=\"71.803551609323\"><\/p>\n<p>The Federal Communications Commission is considering whether to require disclosure when a campaign or group uses artificial intelligence in political advertisements.<\/p>\n<p>Under a <a href=\"https:\/\/docs.fcc.gov\/public\/attachments\/DOC-402740A1.pdf\">proposed regulation<\/a> put forward Wednesday by Chair Jessica Rosenworcel, AI-generated imagery would still be permitted for use in political advertisements on radio, cable and satellite television, but the groups behind those ads would need to disclose use of the technology on air or in writing.<\/p>\n<p>\u201cAs artificial intelligence tools become more accessible, the Commission wants to make sure consumers are fully informed when the technology is used,\u201d Rosenworcel said in a statement. \u201cToday, I\u2019ve shared with my colleagues a proposal that makes clear consumers have a right to know when AI tools are being used in the political ads they see, and I hope they swiftly act on this issue.\u201d<\/p>\n<p>Rosenworcel cited the FCC\u2019s authority under the Bipartisan Campaign Reform Act to protect consumers from false, misleading or deceptive programming.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>If adopted, the agency will seek public comment on a specific definition for AI-generated content and whether such rules should apply to issue-related political advertisements as well as candidates. An FCC spokesperson told CyberScoop that it is agency practice to not release the full text of a proposed regulation unless and until it is adopted by the full commission.<\/p>\n<p>The proposal comes as campaigns and super PACs have sought to leverage generative AI tools in attack ads this election cycle, creating<a href=\"https:\/\/www.axios.com\/2023\/04\/25\/rnc-slams-biden-re-election-bid-ai-generated-ad\"> background imagery<\/a> or<a href=\"https:\/\/www.youtube.com\/watch?v=idS7xEZ6VBs\"> mimicking the voice<\/a> and likeness of political opponents.<\/p>\n<p>The most prominent example came in January when a Democratic operative working on behalf of the Dean Phillips campaign <a href=\"https:\/\/cyberscoop.com\/biden-new-hampshire-robo-call-deepfake\/\">created a deepfake robocall of President Joe Biden<\/a> warning Democrats to stay away from the polls ahead of the party\u2019s New Hampshire primary.<\/p>\n<p>That incident is part of an ongoing state criminal investigation, though no charges have been filed and Steve Kramer, the operative behind the call,<a href=\"https:\/\/cyberscoop.com\/kramer-ai-robocall-lawsuit-response\/\"> told CyberScoop<\/a> in April that he is cooperating with state and federal authorities.<\/p>\n<p>The incident pushed the FCC to<a href=\"https:\/\/www.fcc.gov\/document\/fcc-confirms-tcpa-applies-ai-technologies-generate-human-voices\"> approve<\/a> new language less than a month later affirming that AI-generated robocalls are covered under the Telephone Consumer Protection Act\u2019s prohibition on unwanted calls that use artificial or prerecorded voices.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>A number of <a href=\"https:\/\/fedscoop.com\/senators-discuss-new-legislation-focused-on-deceptive-ai-and-elections\/\">bills<\/a> have been <a href=\"https:\/\/fedscoop.com\/bill-would-mandate-political-ad-ai-use-disclosure\/\">introduced<\/a> in Congress that would<a href=\"https:\/\/www.congress.gov\/bill\/118th-congress\/house-bill\/3044\"> mandate similar disclosures<\/a> in political ads, place new restrictions<a href=\"https:\/\/www.congress.gov\/bill\/118th-congress\/house-bill\/4611\/text\"> around voice cloning<\/a> of political candidates and push agencies like the Federal Election Commission or Federal Trade Commission to develop or enforce specific regulations around the issue. However, none have made it to a floor vote or been passed into law.<\/p>\n<p>The FEC voted last year to open public comment on whether to require disclosure of AI in political ads, but campaign finance experts have told CyberScoop that any proposed regulation would not be approved in time to impact the 2024 election.<\/p>\n<p>Last year, the American Association of Political Consultants<a href=\"https:\/\/theaapc.org\/american-association-of-political-consultants-aapc-condemns-use-of-deceptive-generative-ai-content-in-political-campaigns-2\/\"> condemned<\/a> the use of generative AI in political advertisements, saying its use goes against the organization\u2019s professional code of ethics, even if candidates and organizations disclose their use of the technology upfront.<\/p>\n<p>\u201cCitizens must have confidence in the basic truthfulness of political campaigns,\u201d the organization said. \u201cWhile the public\u2019s trust in institutions and campaigns has been shaken in recent decades, the use of \u2018deepfake\u2019 generative AI content is a dramatically different and dangerous threat to democracy.\u201d<\/p>\n<p><\/body> <\/p>\n<footer class=\"single-article__footer\" readability=\"3.3231810490694\">\n<div class=\"author-card\" readability=\"13\">\n<div class=\"author-card__avatar\">\n<figure class=\"author-card__image-wrap\"> <img data-recalc-dims=\"1\" decoding=\"async\" class=\"author-card__image\" src=\"https:\/\/i0.wp.com\/ddi.mohflo.net\/wp-content\/uploads\/2024\/05\/fcc-pushes-new-disclosure-requirements-for-ai-in-political-ads-1.jpg?w=640&ssl=1\" alt=\"Derek B.
