(Getty Images) <\/figcaption><\/figure>\n<\/p><\/div>\n<\/header>\n<div class=\"single-article__content\">\n<div class=\"single-article__content-inner has-drop-cap\"> <html readability=\"61.428794747538\"><body readability=\"125.73096976017\"><\/p>\n<p>Congressional action is needed to streamline the cybersecurity regulatory landscape, a White House official said Wednesday during a hearing that saw lawmakers and witnesses rail against what they say is an overly complicated patchwork of cyber rules that hinders the private sector\u2019s ability to fight off threats.<\/p>\n<p>Wednesday\u2019s <a href=\"https:\/\/www.hsgac.senate.gov\/hearings\/streamlining-the-federal-cybersecurity-regulatory-process-the-path-to-harmonization\/\">hearing<\/a> before the Senate Homeland Security and Governmental Affairs Committee, held a day after the Office of the National Cyber Director issued a <a href=\"https:\/\/www.whitehouse.gov\/wp-content\/uploads\/2024\/06\/Cybersecurity-Regulatory-Harmonization-RFI-Summary-ONCD.pdf\">report<\/a> in response to a request for information on cybersecurity regulatory harmonization, featured relatively broad agreement among committee members and federal officials on the need for a legislative solution.<\/p>\n<p>Though a proposed solution of that kind hasn\u2019t yet been introduced, a draft bill from committee Chair Sen. Gary Peters, D-Mich., was cited multiple times during the hearing as a way to remedy the streamlining problem. A <a href=\"https:\/\/www.documentcloud.org\/documents\/24699825-ell23595-discussion-draft-cyber-reg-harm-1\">draft copy<\/a> of Peters\u2019 Cybersecurity Regulation Harmonization Act, obtained by <a href=\"https:\/\/therecord.media\/gary-peters-legislation-new-committee-oncd-harmonize-cyber-regulations\">The Record<\/a>, calls for the creation of an interagency committee to coordinate cyber regulations.<\/p>\n<p>Regulatory harmonization \u201cis a problem that has existed for decades and the trend line is generally heading toward more fragmentation, not more harmonization,\u201d said Nicholas Leiserson, the assistant national cyber director for cyber policy and programs. \u201cIt is a problem that requires leadership from ONCD and Congress informed by the private sector.\u201d <\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>Leiserson said the Biden administration is supportive of Peters\u2019 legislation, calling it \u201cconsistent with the views\u201d ONCD has previously shared with the committee. The bill, he added, \u201cwould allow ONCD to better carry out our mission by bringing independent regulatory commissions to the table together with the interagency in a policymaking process.\u201d<\/p>\n<p>Rulemaking from independent agencies has drawn plenty of ire from the private sector, most notably in the case of the Securities and Exchange Commission\u2019s <a href=\"https:\/\/cyberscoop.com\/sec-cybersecurity-incidents-disclosure-rule\/\">cybersecurity incident disclosure rules<\/a>. <\/p>\n<p>Peters noted in his opening statement that federal regulators have passed 48 rules on cybersecurity standards over the past four years. Though he said that regulatory push \u201ccomes from a good place,\u201d absent a higher level of coordination \u201cthere is no way to ensure that these guidelines don\u2019t overlap, duplicate, or quite simply contradict each other,\u201d leading to results that \u201care often confusing and inefficient.\u201d<\/p>\n<p>Sen. James Lankford, R-Okla., echoed Peters\u2019 concerns, particularly with regard to independent agencies that \u201cstill need additional oversight.\u201d<\/p>\n<p>\u201cThere are independent agencies that feel like they\u2019re independent from everybody. They\u2019re not independent from everybody,\u201d Lankford said. \u201cThere\u2019s still some boundaries that need to be there when they\u2019re creating new regs, that they\u2019re not a completely independent fourth branch of government.\u201d<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>ONCD is \u201climited\u201d in its ability to corral independent regulatory commissions, Leiserson said, underscoring the need for congressional involvement. Getting all relevant parties to the table is paramount, he added, something that became especially clear as ONCD analyzed the more than 2,000 pages of comments in response to its request for information. In <a href=\"https:\/\/www.whitehouse.gov\/oncd\/briefing-room\/2024\/06\/04\/we-need-to-harmonize-cybersecurity-regulations-what-we-heard-from-our-partners\/\">a report<\/a> published Wednesday, the ONCD sought to summarize the 86 unique responses to that request.<\/p>\n<p>The Business Roundtable, for example, said that burdensome and often conflicting regulations \u201crequire companies to devote more resources to fulfilling technical compliance requirements without improving cybersecurity outcomes.\u201d The Bank Policy Institute <a href=\"https:\/\/bpi.com\/wp-content\/uploads\/2024\/06\/BPI-Statement-for-the-Record-Streamlining-the-Federal-Cybersecurity-Regulatory-Process.pdf\">noted<\/a> that a survey of large financial institutions found that chief information security officers or comparable senior cyber leaders spend between 30% to 50% of their time on regulatory compliance matters. And the National Defense Industry Association said that regulatory \u201cinconsistencies\u201d erect \u201cbarriers to entry\u201d for small and mid-sized businesses. <\/p>\n<p>\u201cWhen you have multiple reporting regimes with multiple requirements that are not alike, you spend a lot of time doing paperwork rather than focusing on your job, because you need to meet the requirements of both of these frameworks that you\u2019re subject to,\u201d said David Hinchman, director of information technology and cybersecurity at the Government Accountability Office, which released a corresponding <a href=\"https:\/\/www.gao.gov\/products\/gao-24-107602\">report<\/a> Wednesday on cyber harmonization. <\/p>\n<p>A lack of federal cyber harmonization also negatively impacts the ability of U.S. companies to compete internationally, Leiserson said, noting that European firms only need to worry about operating under the E.U. framework.
