The first is <a href=\"https:\/\/cyberscoop.com\/cisa-secure-by-design-commitments-tech-companies\/\">a \u201csecure-by-design\u201d partnership<\/a> with the tech sector to shift the burden of software security toward its initial developers; the second is <a href=\"https:\/\/cyberscoop.com\/spyware-biden-administration-democracy-summit\/\">the formation of an international coalition<\/a> to curb the proliferation of commercial spyware.<\/p>\n<p>Recent developments in the tech sector, however, illustrate just how far both initiatives have to go in delivering actual security and privacy gains. Last month, Microsoft <a href=\"https:\/\/archive.is\/OSTQ1\">announced<\/a> that it would roll out a feature dubbed \u201cRecall\u201d to its Windows PCs that would capture a detailed, indexed history of all on-device activities. The product purported to use AI to allow the user to recall any past activity, relying on archived screenshots of a user\u2019s on-screen behavior \u2014 including log-ins, queries, financial account numbers and contacts. Google <a href=\"https:\/\/www.pcworld.com\/article\/2358215\/google-is-working-on-a-version-of-recall-too.html\">is reportedly considering<\/a> rolling out a similar tool for its Chromebooks.<\/p>\n<p>This rush-to-market approach is in conflict with the Biden administration\u2019s initiatives on secure by design and countering spyware but has been met by silence from the White House and key cyber officials. Anyone with access to a Recall-outfitted device \u2014 whether a foreign intelligence service or an abusive spouse \u2014 <a href=\"https:\/\/www.malwarebytes.com\/blog\/news\/2024\/06\/microsoft-recall-snapshots-can-be-easily-grabbed-with-totalrecall-tool\">would have been able to access<\/a> this \u201cphotographic memory\u201d with ease, suggesting a serious failure to beta-test or independently validate program security prior to its release. This runs contrary to the Microsoft\u2019s commitment in <a href=\"https:\/\/www.cisa.gov\/sites\/default\/files\/2023-10\/SecureByDesign_1025_508c.pdf\">CISA\u2019s secure-by-design pledge<\/a> to build products that \u201care conceptualized with the security of customers as a core business goal, not just a technical feature.\u201d<\/p>\n<p>For those who have ever worked in cybersecurity \u2014 or digital espionage, for that matter \u2014 creating such a granular, searchable history of one\u2019s digital life, potentially accessible to outsiders, looks like a privacy and security <a href=\"https:\/\/www.cnet.com\/tech\/services-and-software\/microsofts-ai-recall-feature-for-copilot-plus-pcs-sees-backlash-from-security-experts\/\">catastrophe<\/a> in a box. While the United States and its partners <a href=\"https:\/\/www.state.gov\/joint-statement-on-efforts-to-counter-the-proliferation-and-misuse-of-commercial-spyware\/\">aim<\/a> to \u201cprevent the export of software, technology, and equipment to end-users who are likely to use them for malicious cyber activity, including unauthorized intrusion,\u201d a vulnerable, on-device activity log all but invites malicious actors to target a system like Recall, while diminishing their need for sophisticated intrusion tools entirely.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>In recent days, researchers have demonstrated how <a href=\"https:\/\/www.wired.com\/story\/microsoft-windows-recall-privilege-escalation\/\">easily circumventable<\/a> Microsoft\u2019s safeguards for Recall are and have spoken out <a href=\"https:\/\/doublepulsar.com\/recall-stealing-everything-youve-ever-typed-or-viewed-on-your-own-windows-pc-is-now-possible-da3e12e9465e\">in blunt terms<\/a> to question how a company still under intense government scrutiny for <a href=\"https:\/\/www.cisa.gov\/resources-tools\/resources\/cyber-safety-review-board-releases-report-microsoft-online-exchange-incident-summer-2023\">neglecting<\/a> basic cybersecurity measures \u2014 and <a href=\"https:\/\/www.cisa.gov\/securebydesign\/pledge\">signatory<\/a> to CISA\u2019s \u201csecure-by-design\u201d pledge \u2014 manages to sustain such a cavalier approach to product design.<\/p>\n<p>Less a checklist than a philosophical approach to better security at earlier phases of product development, CISA\u2019s secure-by-design pledge is a multi-national, public-private roadmap to push responsibility for securing digital systems \u201cupstream, with the manufacturers, where it has the greatest likelihood of reducing the chances of compromise.\u201d It is an approach minimizing both the risks to, and required vigilance by, the end-user. It aims to signify a shift in mindset among its signatories about what \u201csecurity\u201d entails \u2014 as something baked in from inception rather than bolted on after shipping. Recall appears to flout the pledge in both spirit and letter.<\/p>\n<p>Products like Recall not only run counter to the Biden administration\u2019s efforts to promote the development of secure software but also undermine the administration\u2019s attempts to stunt the proliferation of spyware. Last year, the Biden administration <a href=\"https:\/\/archive.is\/2imdo\">rolled out<\/a> its Joint Statement on Efforts to Counter the Proliferation and Misuse of Commercial Spyware, <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/press-briefings\/2024\/03\/18\/background-press-call-on-u-s-efforts-to-counter-misuse-of-commercial-spyware-and-the-third-summit-for-democracy\/#:~:text=And%20at%20the%20summit%2C%20in,governments%20that%20are%20focused%20on\">which has now been signed by 17 democracies<\/a>. That document references the need to prevent \u201cthe export of software, technology, and equipment to end-users who are likely to use them for malicious cyber activity, including unauthorized intrusion into information systems.\u201d A complementary <a href=\"https:\/\/whitehouse.gov\/briefing-room\/statements-releases\/2023\/03\/27\/fact-sheet-president-biden-signs-executive-order-to-prohibit-u-s-government-use-of-commercial-spyware-that-poses-risks-to-national-security\/\">executive order<\/a> forbids U.S. agencies from using commercial spyware solutions that pose a national security threat to the United States.<\/p>\n<p>Amidst the rollout of the joint statement and executive order last spring, White House officials asserted that these initiatives were designed to leverage the substantial purchasing power of the U.S. and likeminded governments, to render a chilling effect on the burgeoning market for commercial spyware. The United Kingdom and France <a href=\"https:\/\/www.gov.uk\/government\/publications\/the-pall-mall-process-declaration-tackling-the-proliferation-and-irresponsible-use-of-commercial-cyber-intrusion-capabilities\">followed suit<\/a> soon thereafter with their own Pall Mall Process declaration \u2014 an international coalition designed to curb the proliferation of a broader suite of commercially available cyber intrusion tools. The implicit message to tech developers is that signatory governments with hefty budgets won\u2019t buy products from vendors who cater to autocrats and illicit actors who disregard human rights and the rule of law. But Microsoft\u2019s Recall begs the question of where the line between \u201ccatering to\u201d and \u201cleaving the door open for\u201d might be drawn. Company representatives have been publicly <a href=\"https:\/\/www.techspot.com\/news\/103301-microsoft-research-scientist-gives-non-answer-when-asked.html\">evasive<\/a> on that score.<\/p>\n<p>This is where CISA Director Jen Easterly, National Cyber Director Harry Coker, Deputy National Security Advisor Anne Neuberger and Ambassador at Large for Cyberspace and Digital Policy Nate Fick might have taken the lead to demand clarification on behalf of the public and ask how Microsoft\u2019s product announcements align with its security commitments. Instead, a loud and growing chorus of criticism from techies and activists <a href=\"https:\/\/www.wired.com\/story\/microsoft-recall-off-default-security-concerns\/\">appears<\/a> to have augured Microsoft\u2019s partial retreat. The company finally <a href=\"https:\/\/cyberscoop.com\/microsoft-rolls-back-dumbest-cybersecurity-move-in-a-decade\/\">agreed last week<\/a> to make Recall dependent on customer opt-in and to add security features such as enhanced encryption and authentication measures to verify the activity log is accessed only by the device\u2019s owner. Microsoft appears to have been cajoled by critics into offering such security measures as bolt-ons after the fact rather than introducing them by default. But researchers should not have been left to shoulder the burden of calling out these failures.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>The Biden administration and its unquestionably qualified team of cyber leaders deserve immense credit for the unprecedented degree of public and policy focus they\u2019ve lent cybersecurity. Democratic governments deserve credit for the diplomatic heft they\u2019ve applied to the cause. They deserve plaudits for their past willingness to <a href=\"https:\/\/www.cisa.gov\/resources-tools\/resources\/cyber-safety-review-board-releases-report-microsoft-online-exchange-incident-summer-2023\">call out<\/a> major tech companies for flawed strategies and harmful practices. All this progress makes their relative silence amid the rollout of Recall \u2014 a product demonstrably insecure in its design and functionally <a href=\"https:\/\/decrypt.co\/231649\/microsoft-recall-is-spyware-a-privacy-nightmare-security-experts\">spyware<\/a> by another name \u2014 all the more deafening. The episode unfortunately demonstrates a remaining need to back up cyber platitudes and pledges both with more robust regulatory policy and a more active pulpit.<\/p>\n<p><em>Gavin Wilde is a senior
