But if he is able to endure that, cybersecurity experts believe the hearing is unlikely to result in meaningful change. <\/p>\n<p>Coming as it does on the back of numerous bruising reports about the company\u2019s cybersecurity shortcomings, the hearing could produce major drama, but Jim Lewis, who directs the strategic technologies program at the Center for Strategic and International Studies think tank, expects the event to yield little more than \u201critual punishment.\u201d<\/p>\n<p>\u201cEverybody\u2019s mad at Microsoft,\u201d Lewis said, adding that he\u2019s heard frustrations from the White House, industry and Congress about recent cyber operations by Chinese and Russian operatives that have taken advantage of weaknesses in Microsoft products. \u201cIt\u2019s hard to see how the House won\u2019t use it as an opportunity to beat up on them. [Smith] is walking into a bear trap.\u201d<\/p>\n<p>Experts still harbor hope, however, that Thursday\u2019s hearing could catalyze meaningful change at a company that has raised increasing concerns that it has become a major security liability. <\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>The hearing takes its title \u2014 \u201c<a href=\"https:\/\/homeland.house.gov\/hearing\/a-cascade-of-security-failures-assessing-microsoft-corporations-cybersecurity-shortfalls-and-the-implications-for-homeland-security\/\">Cascade of Security Failures\u201d<\/a> \u2014 from <a href=\"https:\/\/cyberscoop.com\/microsoft-csrb-china-hacking\/\">a report of the Department of Homeland Security\u2019s Cyber Safety Review Board<\/a>, which concluded that a Chinese operation to steal a signing key and use it to snoop on emails belonging to senior U.S. government officials was the result of \u201ca cascade of security failures at Microsoft.\u201d <\/p>\n<p>But that incident was just one in <a href=\"https:\/\/cyberscoop.com\/microsoft-rolls-back-dumbest-cybersecurity-move-in-a-decade\/\">a spate<\/a> of <a href=\"https:\/\/cyberscoop.com\/cisa-emergency-directive-tells-agencies-to-fix-credentials-after-microsoft-breach\/\">bad cybersecurity headlines<\/a> for the tech giant, <a href=\"https:\/\/cyberscoop.com\/microsoft-cozy-bear-russia\/\">which recently disclosed<\/a> that hackers linked to Russia\u2019s foreign intelligence agency accessed company source code. <\/p>\n<p>In <a href=\"https:\/\/homeland.house.gov\/wp-content\/uploads\/2024\/06\/2024-06-13-HRG-Testimony-Smith.pdf\">written testimony<\/a> released in advance of the hearing, Smith offered an apology to those impacted by the Chinese breach, including those in the federal government, and acknowledged Microsoft \u201ccan and must do better.\u201d<\/p>\n<p>\u201cIn sum, we accept responsibility for the past and are applying what we\u2019ve learned to help build a more secure future,\u201d Smith said in his prepared testimony. \u201cWe are pursuing new strategies, investing more resources, and fostering a stronger cybersecurity culture.\u201d<\/p>\n<p>One observer of the company anticipates that Smith can use Thursday\u2019s appearance to deflect scrutiny of his firm. Smith is \u201cgood at talking around issues, about issues,\u201d said Cory Simpson, the CEO of the Institute for Critical Infrastructure Technology, who added that he expects \u201cnot much\u201d from the hearing.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>Lewis, too, said Microsoft has proven adept at dodging accountability for its cyber woes, relying on a well-honed \u201cplaybook\u201d that includes <a href=\"https:\/\/cyberscoop.com\/microsoft-security-organizational-changes\/\">hyping its initiative<\/a> last month to declare security its top priority going forward: \u201cGet caught with your pants down, and announce some new security initiative.\u201d<\/p>\n<p>Microsoft has established itself as a key purveyor of software to the federal government, to such a degree that the company\u2019s critics have accused it of <a href=\"https:\/\/www.newsweek.com\/pentagon-hacking-fears-raised-microsoft-military-software-it-antivirus-monopoly-cybersecurity-1794369\">\u201dcreating a security monoculture<\/a>.\u201d Microsoft\u2019s competitors for federal government business have been taking advantage of the company\u2019s blemishes, pressing <a href=\"https:\/\/services.google.com\/fh\/files\/misc\/google_workspace_a_more_secure_alternative.pdf\">publicly for themselves<\/a> as alternatives, <a href=\"https:\/\/netchoice.org\/wp-content\/uploads\/2024\/06\/NetChoice-Letter-for-the-Record-for-US-House-Committee-on-Homeland-and-Security-A-Cascade-of-Security-Failures.pdf\">criticizing Microsoft<\/a> in advance of the hearing and behind the scenes on the Hill. <\/p>\n<p>One such competitor, Trellix Public Chief Technology Officer Karan Sondhi, said he isn\u2019t optimistic about the prospect for change resulting from the hearing, given the vastness of Microsoft\u2019s <a href=\"https:\/\/omdia.tech.informa.com\/-\/media\/tech\/omdia\/marketing\/commissioned-research\/pdfs\/monoculture-and-market-share-the-state-of-communications-and-collaboration-software-in-the-us-government-v3.pdf?rev=8d41cc2d16de491b9f59d2906309fdaa\">market control<\/a> of the sector.<\/p>\n<p>While a legislative solution to reduce the federal government\u2019s reliance would be helpful, Sondhi said he hoped the hearing would inspire agencies to take individual action to purchase products from a multitude of vendors, rather than in a bundle from one company.<\/p>\n<p>\u201cWe\u2019re hoping the hearing will make people realize that they need to do that on their own, without having any legislative body enforcing something,\u201d he said.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>Aside from the cybersecurity impact of Microsoft\u2019s prevalence in federal systems, the committee is likely to question Smith about the company\u2019s presence in China and its approach to artificial intelligence, a committee spokesperson said. \u201cTomorrow is a critical step in helping Congress better understand the evolving threats from our cyber adversaries and fulfill its role in improving our nation\u2019s security posture,\u201d according to the spokesperson.<\/p>\n<p><a href=\"https:\/\/homeland.house.gov\/wp-content\/uploads\/2024\/05\/2024-05-09-CHS-to-Microsoft-Request-to-Testify.pdf\">House Homeland Security panel leaders have said<\/a> they want to hear from Microsoft about its views on its security shortcomings, the challenges of foreign nation-backed hackers and the company\u2019s plans for improvement.<\/p>\n<p>The ideal outcome would be \u201ca great American company coming forward and saying, \u2018mea culpa,\u2019\u201d Simpson said. \u201c\u2018We\u2019ve done some things wrong. We\u2019ve made some errors. We built this culture. We recognize a need to change. And here are the things you can expect from us moving forward that we can collectively look at and measure progress.\u2019\u201d<\/p>\n<p>For Lewis, one potential positive lesson from the hearing is that it would boost the standing of the Cyber Safety Review Board, and give it more incentive to be tougher on companies, he said. <a href=\"https:\/\/www.washingtonpost.com\/politics\/2023\/03\/03\/biden-administration-has-new-cybersecurity-strategy-now-comes-hard-part\/\">DHS has long suggested<\/a> that the board needs the authority to compel companies to cooperate with its probes, <a href=\"https:\/\/cyberscoop.com\/csrb-hearing-authority-transparency\/\">a sentiment shared<\/a> by outside experts.<\/p>\n<p>But even as the ranks of Microsoft critics grow \u2014 the latest is Robert O\u2019Brien, former President Donald Trump\u2019s former national security adviser, <a href=\"https:\/\/thehill.com\/opinion\/cybersecurity\/4714050-microsofts-cybersecurity-vulnerabilities-endanger-america\/\">attacking the company in an op-ed<\/a> \u2014 Smith is set to argue that his company needs the backing of the federal government to defend itself. <\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>\u201cNation-state attackers too often attack without meaningful reprisal, consequence, or deterrence,\u201d Smith said in his prepared testimony. \u201cInternational law or norms of conduct are incomplete and lack meaningful enforcement.\u201d<\/p>\n<p>The U.S. government specifically could do more, Smith said. \u201cDeter nation-state threat actors by imposing appropriate punishment so that the actions of nation-state actors are not without a cost,\u201d his testimony states. \u201cTo accomplish this Congress should assess whether additional steps are needed to strengthen countermeasures against nation-state threat actors.\u201d<\/p>\n<p>Smith also warned that Russia and China may strengthen their already close relationship by carrying out cyberattacks together. \u201cThis is grave at multiple levels,\u201d his testimony reads. \u201cIt\u2019s one thing to engage in cyber combat with four separate nation-state adversaries, but quite another scenario if two or all four of these countries work in tandem.\u201d<\/p>\n<p><\/body> <\/p>\n<footer class=\"single-article__footer\">\n<div class=\"author-card\" readability=\"7.7216117216117\">\n<div class=\"author-card__avatar\">\n<figure class=\"author-card__image-wrap\"> <img data-recalc-dims=\"1\" decoding=\"async\" class=\"author-card__image\" src=\"https:\/\/i0.wp.com\/ddi.mohflo.net\/wp-content\/uploads\/2024\/06\/microsofts-brad-smith-should-prepare-for-ritual-punishment-before-house-hearing-1.jpg?w=640&ssl=1\" alt=\"Tim Starks\"> <\/figure>\n<\/p><\/div>\n<div class=\"author-card__details\" readability=\"10.901098901099\">\n<h4 class=\"author-card__name\">Written by Tim Starks<\/h4>\n<p> Tim Starks is senior reporter at CyberScoop.
