Phil Scott&#8217;s veto of H.121, a bill that would have given the state one of the strongest data privacy protection laws in the US. While the Vermont House voted 128-17 to override, the state Senate voted 14 yeas to 15 nays, leaving the governor&#8217;s veto standing and <\/span><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\"><a class=\"ContentText-BodyTextChunk ContentText-BodyTextChunk_link\" target=\"_blank\" href=\"https:\/\/therecord.media\/vermont-landmark-privacy-bill-killed\" rel=\"noopener\">killing the bill<\/a><\/span><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\">.<\/span><\/p>\n<p class=\"ContentParagraph ContentParagraph_align_left\" data-testid=\"content-paragraph\"><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\">The bill, officially named &#8220;<\/span><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\"><a class=\"ContentText-BodyTextChunk ContentText-BodyTextChunk_link\" target=\"_blank\" href=\"https:\/\/legislature.vermont.gov\/bill\/status\/2024\/H.121\" rel=\"noopener\">An act relating to enhancing consumer privacy and the age-appropriate design code<\/a><\/span><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\">,&#8221; notably contained a right-of-action provision that would allow consumers to sue companies that misused their sensitive data. The other half of the bill, dubbed &#8220;Kids Code,&#8221; would require online services targeted at people under 18 years old to account for privacy and to ensure that all content kids can access is appropriate for children.<\/span><\/p>\n<p class=\"ContentParagraph ContentParagraph_align_left\" data-testid=\"content-paragraph\"><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\">In his June 13 <\/span><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\"><a class=\"ContentText-BodyTextChunk ContentText-BodyTextChunk_link\" target=\"_blank\" href=\"https:\/\/governor.vermont.gov\/press-release\/action-taken-governor-phil-scott-legislation-june-13-2024\" rel=\"noopener\">letter to the General Assembly<\/a><\/span><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\">, Gov. Scott said he was vetoing the bill because the data privacy component would create a hostile business environment in the Green Mountain State. Scott also noted that the Kids Code part of the bills brought up First Amendment issues that California was already dealing with in courts. He recommended that Vermont adopt the less litigious <\/span><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\"><a class=\"ContentText-BodyTextChunk ContentText-BodyTextChunk_link\" target=\"_blank\" href=\"https:\/\/www.darkreading.com\/data-privacy\/new-connecticut-privacy-law-adds-to-the-complex-compliance-maze\" rel=\"noopener\">Connecticut&#8217;s data privacy law<\/a><\/span><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\"> to address the first half and <\/span><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\"><a class=\"ContentText-BodyTextChunk ContentText-BodyTextChunk_link\" target=\"_blank\" href=\"https:\/\/www.darkreading.com\/cyber-risk\/new-california-delete-act-tightens-rules-data-brokers\" rel=\"noopener\">wait for California<\/a><\/span><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\"> to straighten out legal challenges to the second.<\/span><\/p>\n<p class=\"ContentParagraph ContentParagraph_align_left\" data-testid=\"content-paragraph\"><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\">Companies might breathe a sigh of relief to avoid having to meet yet another set of data privacy requirements. If an organization conducts business in the European Union, for example, it has to comply with the <\/span><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\"><a class=\"ContentText-BodyTextChunk ContentText-BodyTextChunk_link\" target=\"_blank\" href=\"https:\/\/www.darkreading.com\/cyber-risk\/thought-gdpr-compliance-was-hard-buckle-up\" rel=\"noopener\">General Data Protection Regulation (GDPR)<\/a><\/span><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\">. As many as <\/span><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\"><a class=\"ContentText-BodyTextChunk ContentText-BodyTextChunk_link\" target=\"_blank\" href=\"https:\/\/iapp.org\/resources\/article\/us-state-privacy-legislation-tracker\/\" rel=\"noopener\">19 US states have passed data privacy laws<\/a><\/span><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\"> of their own, according to an industry interest group. And while <\/span><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\"><a class=\"ContentText-BodyTextChunk ContentText-BodyTextChunk_link\" target=\"_blank\" href=\"https:\/\/www.darkreading.com\/data-privacy\/federal-privacy-bill-that-would-preempt-state-privacy-laws-faces-uncertain-future\" rel=\"noopener\">federal data privacy legislation<\/a><\/span><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\"> is still <\/span><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\"><a class=\"ContentText-BodyTextChunk ContentText-BodyTextChunk_link\" target=\"_blank\" href=\"https:\/\/www.commerce.senate.gov\/2024\/4\/committee-chairs-cantwell-mcmorris-rodgers-unveil-historic-draft-comprehensive-data-privacy-legislation\" rel=\"noopener\">under development<\/a><\/span><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\">, President Joe <\/span><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\"><a class=\"ContentText-BodyTextChunk ContentText-BodyTextChunk_link\" target=\"_blank\" href=\"https:\/\/www.darkreading.com\/cyber-risk\/biden-administration-unveils-data-privacy-executive-order\" rel=\"noopener\">Biden issued an executive order<\/a><\/span><span class=\"ContentText ContentText_variant_bodyNormal\" data-testid=\"content-text\"> at the end of February 2024 to firm up policies about how user data is handled nationally and internationally.<\/span><\/p>\n<p><a
