(Photo by Jessica McGowan\/Getty Images) <\/figcaption><\/figure>\n<\/p><\/div>\n<\/header>\n<div class=\"single-article__content\">\n<div class=\"single-article__content-inner has-drop-cap\"> <html readability=\"33.285791464073\"><body readability=\"69.042034724337\"><\/p>\n<p>Cybersecurity vendor CrowdStrike fired back at major U.S. airline Delta over a lawsuit threat stemming from a flawed software update that led to flight cancellations, saying that if the company followed through it would have to provide public details about its own failings.<\/p>\n<p>\u201cCrowdStrike is highly disappointed by Delta\u2019s suggestion that CrowdStrike was grossly negligent or committed willful misconduct with regard to the\u201d incident, attorney Michael Carlinsky <a href=\"https:\/\/cyberscoop.com\/wp-content\/uploads\/sites\/3\/2024\/08\/2024.08.04-CrowdStrike-Response-to-Delta-7.29.24-Letter.pdf\">wrote in a letter Sunday<\/a> to fellow attorney David Boies, whom Delta has hired to seek damages from CrowdStrike and Microsoft.<\/p>\n<p>It\u2019s the latest shoe to drop in the drama that began last month when a CrowdStrike Falcon update <a href=\"https:\/\/cyberscoop.com\/crowdstrike-falcon-flaw-microsoft-outage-flights-grounded-windows\/\">caused millions of Microsoft computers to malfunction<\/a>. <\/p>\n<p>The incident hit airlines particularly hard, with Delta struggling most of all. CEO Ed Bastian said last week that Delta is \u201cheavy with both\u201d CrowdStrike and Microsoft and that the incident has cost the airline $500 million, leading the company to retain Boies\u2019 services.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>\u201cWe have no choice,\u201d <a href=\"https:\/\/www.cnbc.com\/video\/2024\/07\/31\/delta-air-lines-ceo-on-crowdstrike-outage-cost-us-half-a-billion-dollars-in-five-days.html\">Bastian said on CNBC<\/a>. \u201cOver a period of five days, between not just the lost revenue, but the tens of millions of dollars per day in compensation and hotels. \u2026 You can\u2019t come into a mission critical 24\/7 operation and tell us we have a bug. It doesn\u2019t work.\u201d<\/p>\n<p>Bastian also said in the interview that CrowdStrike hadn\u2019t offered \u201canything\u201d in the way of \u201cfree consulting advice to help us,\u201d a claim that CrowdStrike disputed. Delta declined to comment to CyberScoop beyond what was said in the CNBC interview.<\/p>\n<p>CrowdStrike CEO George Kurtz reached out directly to Bastian to offer onsite assistance but didn\u2019t get a response, according to the letter. The company reached out \u201cwithin hours\u201d to offer help, and after a follow-up, Delta said that onsite assistance wouldn\u2019t be necessary, Carlinsky wrote \u2014 an offer other customers accepted. Even now, CrowdStrike is working with Delta\u2019s IT team, he said.<\/p>\n<p>\u201cDelta\u2019s public threat of litigation distracts from this work and has contributed to a misleading narrative that CrowdStrike is responsible<em> for Delta\u2019s IT decisions and response other than the outage<\/em>,\u201d the letter states, emphasis theirs. And Carlinsky wrote that any liability is contractually capped at the single-digit millions.<\/p>\n<p>Should Delta sue, it will have to explain publicly why its competitors restored operations more quickly, according to the letter. <a href=\"https:\/\/www.cnbc.com\/2024\/08\/02\/delta-ceo-offers-employees-free-flights-after-crowdstrike-microsoft-chaos.html\">Delta canceled<\/a> more than 5,000 flights between July 19 and July 24, according to the flight tracker FlightAware. <a href=\"https:\/\/www.ciodive.com\/news\/american-airlines-crowdstrike-outage-operatioins-recovery\/722428\/\">American Airlines<\/a>, meanwhile, canceled 400 flights on the first day of the incident and 50 more the next.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>Transportation Secretary Pete Buttigieg has criticized Delta specifically over the incident and <a href=\"https:\/\/www.instagram.com\/reel\/C90lC1HhHYd\/\">launched an investigation<\/a> into the company.<\/p>\n<p>\u201cThe letter speaks for itself,\u201d a CrowdStrike spokesperson said. \u201cWe have expressed our regret and apologies to all of our customers for this incident and the disruption that resulted. Public posturing about potentially bringing a meritless lawsuit against CrowdStrike as a long-time partner is not constructive to any party.
