(Photo by Samuel Corum\/Getty Images) ***Local Caption *** Ben Ray Lujan <\/figcaption><\/figure>\n<\/p><\/div>\n<\/header>\n<div class=\"single-article__content\">\n<div class=\"single-article__content-inner has-drop-cap\"> <html readability=\"31.024489347683\"><body readability=\"68.352542372881\"><\/p>\n<p>The $3 billion that Congress folded into the annual defense policy bill to remove Chinese-made telecommunications technology from U.S. networks would be a huge start to defending against breaches like the Salt Typhoon espionage campaign, senators and hearing witnesses said Wednesday.<\/p>\n<p>Federal Communications Commission Chairwoman Jessica Rosenworcel <a href=\"https:\/\/docs.fcc.gov\/public\/attachments\/DOC-407870A1.pdf\">recently told Hill leaders<\/a> that the $1.9 billion Congress had devoted to the \u201crip and replace\u201d program to get rid of Huawei and ZTE equipment left the agency with a $3.08 billion hole to reimburse 126 carriers for eliminating use of that tech, \u201cputting our national security and the connectivity of rural consumers who depend on these networks at risk.\u201d<\/p>\n<p>The fiscal 2025 National Defense Authorization Act (NDAA), which passed the House by a 281-140 vote Wednesday, contains language authorizing funds to fill that gap. Sen. Ben Ray Luj\u00e1n, the New Mexico Democrat who chairs the Commerce Subcommittee on Communications, Media and Broadband, said at Wednesday\u2019s hearing of his panel that Congress should approve that funding even though there\u2019s much still unknown about the attacks from the Chinese government hackers known as <a href=\"https:\/\/cyberscoop.com\/tag\/salt-typhoon\/\">Salt Typhoon<\/a>.<\/p>\n<p>\u201cWhat we do know is that more must be done to prevent attacks like this in the future,\u201d he said. \u201cOne obvious thing we can do today is get equipment manufactured by companies that collaborate with our foreign adversaries out of our American networks. \u2026 I\u2019m hopeful that there\u2019s strong bipartisan agreement to fully fund this program through this year\u2019s National Defense Authorization Act and address one of the major known vulnerabilities facing our networks every day once and for all.\u201d<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>Congressional action on the \u201crip and replace\u201d program \u201cdemonstrates that Congress can take bipartisan action to secure our networks, an approach that is urgently needed now as we take steps to confront the challenges posed by China,\u201d said Sen. Jerry Moran, R-Kan.<\/p>\n<p>Tim Donovan, president and CEO of the Competitive Carriers Association that represents telecommunications providers and vendors, said that for rural carriers deciding whether to remove equipment but not replace it under the program\u2019s original timeline, \u201cthe situation is dire.\u201d Equipment still in place can\u2019t be upgraded.<\/p>\n<p>\u201cIf Salt Typhoon can hack major operators, then there\u2019s a flashing red light for \u2018rip and replace\u2019 networks that do not have the same resources,\u201d he testified.<\/p>\n<p>The timing on final passage of the NDAA remains up in the air in the Senate following <a href=\"https:\/\/www.nbcnews.com\/politics\/congress\/house-poised-pass-massive-defense-bill-ban-gender-affirming-care-trans-rcna183810\">the House\u2019s approval<\/a> Wednesday. Some Democrats have opposed the NDAA <a href=\"https:\/\/thehill.com\/homenews\/house\/5030532-house-armed-services-bill-transgender\/\">over provisions<\/a> related to transgender medical treatment. Prior to lawmakers reaching a deal and releasing the final version of the legislation over the weekend, incoming Senate Majority Leader John Thune, R-S.D., said <a href=\"https:\/\/www.thune.senate.gov\/public\/index.cfm\/2024\/11\/thune-the-senate-must-prioritize-the-ndaa\">the GOP would prioritize it<\/a> when they assume control of the chamber from Democrats next month \u2014 assuming it doesn\u2019t pass before then.<\/p>\n<p>Some Republican senators at the hearing also cast doubt on <a href=\"https:\/\/cyberscoop.com\/fcc-cybersecurity-rules-wiretapping-law-salt-typhoon\/\">a recent FCC proposal<\/a> to regulate telecommunications firms\u2019 cybersecurity under the 1994 Communications Assistance for Law Enforcement Act. Texas Sen. Ted Cruz, the top Republican on the full Commerce panel, said the Biden administration shouldn\u2019t \u201crush into regulatory expansion\u201d as an answer.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>But Sen. Ed Markey, D-Mass., said the FCC was taking needed action and telecommunications companies have to invest more resources to safeguard their systems.
