(Scoop News Group photo) <\/figcaption><\/figure>\n<\/p><\/div>\n<\/header>\n<div class=\"single-article__content\">\n<div class=\"single-article__content-inner has-drop-cap\"> <html readability=\"55.871178225205\"><body readability=\"118.54716981132\"><\/p>\n<p>Days after the four-year anniversary of the creation of the Office of the National Cyber Director and days before its current chief is set to depart, that man, Harry Coker Jr., looked both backward and forward at the office in a speech Tuesday and a separate interview with CyberScoop.<\/p>\n<p>Coker touched on software liability, regulations, the authorities of his office, federal agency cybersecurity, the cyber workforce and the biggest cyber weakness insufficiently addressed right now.<\/p>\n<p><a href=\"https:\/\/www.whitehouse.gov\/oncd\/briefing-room\/2025\/01\/07\/remarks-national-cyber-director-coker-at-foundation-for-the-defense-of-democracies\/\">His speech<\/a> at the Foundation for Defense of Democracies laid out Office of the National Cyber Director (ONCD) achievements, both during his tenure and that of his predecessors, from leading the writing of a national cybersecurity strategy and implementing it to addressing memory-safe coding language to encouraging agencies to improve secure internet routing.<\/p>\n<p>But the office still has more informal authority than formal powers, Coker told CyberScoop, which is something the next administration could examine.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>\u201cI think that as we grow, as we have grown, we are able to take on more responsibilities,\u201d he said of his 80-plus staff. \u201cWe currently do not have a role in the national security policy process.\u201d <\/p>\n<p>The office works with agencies like the National Security Council, and does so gladly, but it lacks the authority to convene on its own, he said. \u201cThere are some times when ONCD ought to be able to go \u2014 not go it alone \u2014 but initiate and lead through that process. That changes depending upon what a president wants to do\u2026 and that is one area that I think should be improved upon.\u201d <\/p>\n<p>Another area where the Trump administration could make headway is on cyber regulation harmonization. He said he was disappointed Congress didn\u2019t get legislation into law <a href=\"https:\/\/cyberscoop.com\/cybersecurity-regulations-harmonization-federal-agencies-senate-bill\/\">giving ONCD a stronger role<\/a> in de-conflicting various federal cyber rules. <\/p>\n<p>\u201cWhat that will do is decrease the cost of doing business and increase cybersecurity,\u201d something that ought to be bipartisan, Coker said. \u201cYou\u2019ve got to get past the sound bites and make that happen. I think it\u2019s just, some folks are opposed to regulation and put \u2018regulation\u2019 in the title that\u2019s going to raise the hackles of some individuals.\u201d<\/p>\n<p>Coker also said a symposium the office <a href=\"https:\/\/www.whitehouse.gov\/oncd\/briefing-room\/2024\/03\/27\/readout-software-liability-symposium\/\">hosted with the legal research community<\/a> should soon provide options for the new administration to address software liability, following consultations with the private sector.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>There could be significant turnover in his office since around half of the positions are political appointments, and Coker said the operating presumption is that most of them will depart. However he\u2019s not aware of any plans from nonpolitical employees to depart as a result of the change in administration.<\/p>\n<p>An executive order last week on the order of ONCD succession <a href=\"https:\/\/www.politico.com\/newsletters\/weekly-cybersecurity\/2025\/01\/06\/the-cyber-succession-flare-up-00196550\">raised a kerfuffle<\/a> with some Trump allies, although Coker said it was innocent. Most organizations have succession plans, he said, but he could understand why the timing would appear suspicious to those who were.<\/p>\n<p>Going forward, one of the biggest gaps in cybersecurity is protecting state, local, tribal and territorial governments, Coker said.<\/p>\n<p>\u201cI am very concerned with our national deficit, so I\u2019m not going to say we need more money\u201d to address security for those entities, he said. \u201cI\u2019m saying there\u2019s enough money being spent in the federal government, but we need to figure out how to prioritize cybersecurity. So do they need more resources? Yes, that is talent, that is software capability, and yes, that requires money. There are so many holes that it is going to have to be a yearslong effort, and it\u2019s going to have to be some level of shared services.\u201d<\/p>\n<p>Prioritizing spending on cybersecurity within the federal government will require an evolution, too, he said. He noted that the ONCD and the Office of Management and Budget have given budget guidance, but needs to consider \u201cbudget direction\u201d instead.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>\u201cI\u2019ll make it analogous to <a href=\"https:\/\/cyberscoop.com\/bidens-cybersecurity-legacy-a-big-shift-to-private-sector-responsibility\/\">voluntary requirements versus regulation<\/a>\u201d in the private sector, Coker said. \u201cWe\u2019ve gone past the point of asking departments and agencies to sufficiently fund cybersecurity.
