(BRENDAN SMIALOWSKI\/AFP via Getty Images) <\/figcaption><\/figure>\n<\/p><\/div>\n<\/header>\n<div class=\"single-article__content\">\n<div class=\"single-article__content-inner has-drop-cap\"> <html readability=\"50.333277395536\"><body readability=\"100.79177377892\"><\/p>\n<p>The Federal Communications Commission is tightening up reporting requirements that are meant to prove agencies are cracking down on robocalling and phone number spoofing.<\/p>\n<p>The commission voted Wednesday to adopt <a href=\"https:\/\/www.fcc.gov\/document\/fcc-adopts-stricter-robocall-mitigation-database-filing-requirements-0\">new rules<\/a> that would put in place stricter filing requirements for the Robocall Mitigation Database, a system used by communications providers to report compliance with federal regulations around combating robocalls.<\/p>\n<p>The new rules require voice service providers to make updates to the database within 10 days of getting new information and sets fines of $10,000 and $1,000 for submitting false or inaccurate information. It also requires voice service providers to annually re-certify that their submissions are accurate and sets up a process for implementing two-factor authentication to access the database.<\/p>\n<p>\u201cCompanies using America\u2019s phone networks must be actively involved in protecting consumers from scammers,\u201d FCC Chairwoman Jessica Rosenworcel said in a statement.&nbsp; \u201cWe are tightening our rules to ensure voice service providers know their responsibilities and help stop junk robocalls.\u201d<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>While the changes may seem minor, they\u2019re designed to address reporting shortfalls that have cropped up around the way telecommunications firms prove to the government that they\u2019re working to prevent robocalls on their network.<\/p>\n<p>The database was created by Congress through the <a href=\"https:\/\/www.federalregister.gov\/documents\/2021\/09\/23\/2021-14711\/pallone-thune-telephone-robocall-abuse-criminal-enforcement-and-deterrence-act-traced-act\">Telephone Robocall Abuse Criminal Enforcement and Deterrence<\/a> (TRACED) Act in 2021. That law also mandated that communications providers use a new set of protocols, dubbed STIR\/SHAKEN, to certify to the government that they have done due diligence to ensure that phone numbers making calls over the Internet Protocol portions of their network are being used by the rightful owner.<\/p>\n<p>STIR\/SHAKEN protocols were designed to create verified trails for phone calls as they travel over different networks, with each carrier attesting that they have verified the caller\u2019s identity. This creates a chain of custody for government and private-sector organizations, like the Industry Traceback Group, to investigate. It also ostensibly puts each carrier on the hook for ensuring that mass phone-number spoofing isn\u2019t happening on covered parts of their network.<\/p>\n<p>The Robocall Mitigation Database is how companies report their compliance with STIR\/SHAKEN. However, the <a href=\"https:\/\/cyberscoop.com\/biden-new-hampshire-robo-call-deepfake\/\">Biden AI robocall incident<\/a> ahead of the January 2024 New Hampshire Democratic presidential primary highlighted compliance reporting gaps in the government\u2019s approach.<\/p>\n<p>The calls sent to New Hampshire voters spoofed the phone number of a prominent former state Democratic official and Lingo Telecom, the voice service provider that carried them and <a href=\"https:\/\/cyberscoop.com\/lingo-life-biden-ai-robocall\/\">signed off<\/a> on their authenticity with an A-level rating \u2014 the highest level of confidence a carrier can provide about the validity of the caller.&nbsp;&nbsp;&nbsp;<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>The FCC fined Lingo Telecom $1 million and sent a <a href=\"https:\/\/docs.fcc.gov\/public\/attachments\/DOC-400264A1.pdf\">cease-and-desist letter<\/a> threatening to block their call traffic to other providers if they did not do more to ensure that they are complying with the rules, but the episode also made it clear that the certifications being made by carriers were not being verified or updated in a timely fashion.<\/p>\n<p>\u201cThe [Robocall Mitigation Database] is an essential resource in State [Attorneys General] efforts to combat illegal robocalls. However, too often the information submitted by providers to the RMD is clearly false or inaccurate and demonstrates contempt for the Commission\u2019s requirements and the consumers those requirements protect,\u201d the agency said in its order.<\/p>\n<p>Robocalling continues to be a scourge on American society. According to a 2022 <a href=\"https:\/\/www.nclc.org\/wp-content\/uploads\/2022\/10\/Rpt_Scam_Robocalls_Tables_May-2022.pdf\">report<\/a> from the National Consumer Law Center and the Electronic Privacy Information Center, Americans received more than 21 billion robocalls in 2021.<\/p>\n<p><a href=\"https:\/\/cyberscoop.com\/fcc-jessica-rosenworcel-exit-interview-legacy-cybersecurity-ai\/\">In an interview last month<\/a>, Rosenworcel, the outgoing FCC chair, told CyberScoop that the frequency of robocalling has actually gotten worse since then, as a 2021 Supreme Court <a href=\"https:\/\/www.crowell.com\/en\/insights\/client-alerts\/supreme-court-limits-the-tcpa-s-definition-of-autodialer#:~:text=The%20Supreme%20Court's%20Decision&amp;text=Based%20on%20this%20rule%2C%20the,random%20or%20sequential%20number%20generator.\">decision<\/a> adopted a definition for autodialing that essentially \u201cfroze the definition of the technology in 1991.\u201d She pushed for Congress to update that authority for modern telecommunications technology and give the agency the authority to take bad actors to court to enforce their mandates.<\/p>\n<p>David Frankel, CEO of ZipDX, a robocall surveillance platform, told CyberScoop that the new rules are welcome and could improve the accuracy of protocols like STIR\/SHAKEN.<\/p>\n<p>\u201cBy cross-referencing that signer to their entry in the [database], you can know something about that entity,\u201d Frankel said. \u201cAnd over time, each provider earns a reputation \u2014 good or bad \u2014 based on real-life experience with the calls they are signing.\u201d&nbsp;<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>Frankel said the impact of the new rules probably won\u2019t be noticed by consumers right away, but they could reach a very important group within the telecom ecosystem. While there are bad actors who are \u201ctruly rotten and manipulating the system\u201d to facilitate mass robocalling, there is a large group of telecoms \u2014 including major players like AT&amp;T, T-Mobile and Verizon \u2014 who aren\u2019t explicitly gaming the system but also aren\u2019t incentivized to do much about the problem.<\/p>\n<p>\u201cWhat this new order may do is give more of the \u2018middle of the road\u2019 players cover to do more,\u201d Frankel said. \u201cThose players need to \u2018just say no\u2019 to the really bad guys.
