(Photo by Kevin Dietsch\/Getty Images) <\/figcaption><\/figure>\n<\/p><\/div>\n<\/header>\n<div class=\"single-article__content\">\n<div class=\"single-article__content-inner has-drop-cap\"> <html readability=\"46.627163781625\"><body readability=\"94.858306538049\"><\/p>\n<p>Tulsi Gabbard, President Donald Trump\u2019s nominee for director of national intelligence, told the Senate Intelligence Committee on Thursday that she would leave her own political views \u201cat the door\u201d and deliver \u201cintelligence that is collected, analyzed and reported without bias, prejudice or political influence.\u201d<\/p>\n<p>But she also accused the Biden administration and other national security officials of politicizing intelligence to make Trump look like Russian President Vladimir Putin\u2019s \u201cpuppet\u201d and said Trump\u2019s reelection was a \u201cclear mandate from the American people to break the cycle of failure and the weaponization and politicization of the intelligence community.\u201d<\/p>\n<p>Gabbard\u2019s nomination to lead the nation\u2019s top intelligence agency is opposed by national security experts for many reasons, including her defense of past information leaks and her criticism of a key U.S. surveillance program.&nbsp;&nbsp;<\/p>\n<p>In his opening statement, ranking member Mark Warner, D-Va., raised questions about a number of Gabbard\u2019s past statements and positions.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>Chief among those concerns is her position switch on Section 702, a section of the Foreign Intelligence Surveillance Act that authorizes intelligence agencies to collect, analyze and share signals intelligence related to national security threats. While the program is <a href=\"https:\/\/www.dni.gov\/files\/CLPT\/documents\/2024_ASTR_for_CY2023.pdf\">targeted at&nbsp; foreign sources<\/a>, it also sweeps up millions of phone records and metadata of<a href=\"https:\/\/documents.pclob.gov\/prod\/Documents\/OversightReport\/d21d1c6b-6de3-4bc4-b018-6c9151a0497d\/2023%20PCLOB%20702%20Report,%20508%20Completed,%20Dec%203,%202024.pdf\"> American citizens and U.S. persons<\/a> that can later be searched by agencies like the FBI in domestic investigations.<\/p>\n<p>Gabbard had previously described Section 702 as \u201coverreach,\u201d and as a member of the House introduced <a href=\"https:\/\/x.com\/TulsiGabbard\/status\/1339249493921984520?ref_src=twsrc%5Etfw\">legislation<\/a> to repeal the program. Since being nominated, Gabbard has <a href=\"https:\/\/www.nbcnews.com\/politics\/national-security\/gabbards-surveillance-flip-will-spotlight-dni-hearing-rcna189643\">made statements<\/a> characterizing the program as a \u201cvital national security tool.\u201d&nbsp;&nbsp;<\/p>\n<p>Warner described that change of heart as \u201cwelcome\u201d but \u201cnot credible\u201d given the timing.<\/p>\n<p>Gabbard said that Congress and the Foreign Intelligence Surveillance Court, rather than ODNI, should decide whether warrants are required for accessing data on U.S. persons. She remained noncommittal on whether she supported provisions in an <a href=\"https:\/\/www.washingtonpost.com\/national-security\/2024\/04\/20\/congress-extends-controversial-warrantless-surveillance-law-two-years\/\">extension<\/a> of Section 702 that required device owners to cooperate with data requests from the government.<\/p>\n<p>Warner also castigated Gabbard for praising former NSA contractor Edward Snowden as a \u201cbrave whistleblower\u201d deserving of a pardon, and claiming in pre-hearing interviews that the director of national intelligence did not have a role in determining whether Snowden was a \u201clawful whistleblower.\u201d Snowden\u2019s 2013 leak exposed numerous global surveillance programs being run by the NSA, the U.S. government and by allies in the Five Eyes Alliance.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>Those revelations led to significant legal and bureaucratic reforms around the way intelligence and law enforcement agencies can collect and use call information and metadata of U.S. persons, but Warner described Snowden as \u201csomeone who betrayed the trust and jeopardized the security of our nation.\u201d<\/p>\n<p>\u201cWhat message would it send to the intelligence workforce to have a DNI who would celebrate staff and contractors deciding to leak our nation\u2019s most sensitive secrets as they see fit?\u201d Warner said.<\/p>\n<p>But during questioning from Warner, Gabbard again backtracked, saying flatly that Snowden \u201cbroke the law\u201d and that he should have gone through official government channels to report wrongdoing.<\/p>\n<p>She continued to defend her criticism of U.S. surveillance programs and noted that Snowden\u2019s disclosures led to government reform, calling them \u201creflective of the egregious and illegal programs that were exposed in that leak.\u201d She also declined to answer if she believed Snowden was a \u201ctraitor.\u201d<\/p>\n<p>\u201cI take very seriously the protection of American civil liberties and our Fourth Amendment rights,\u201d Gabbard told Sen. Angus King, I-Maine. \u201cIf confirmed as director of national intelligence, I\u2019d make sure there\u2019s no further Snowden-type leak in the future and that those who have concerns have legal channels to raise those concerns so that we don\u2019t violate and release our nation\u2019s secrets.\u201d<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>Snowden, for his part, commented on social media that he believes Gabbard would not be able to answer questions about him truthfully and maintain support for her nomination in Congress.<\/p>\n<p>\u201cTulsi Gabbard will be required to disown all prior support for whistleblowers as a condition of confirmation [Thursday]. I encourage her to do so,\u201d Snowden <a href=\"https:\/\/x.com\/Snowden\/status\/1884935491423777093\">wrote<\/a> on X. \u201cTell them I harmed national security and the sweet, soft feelings of staff.
