(Photo by Kayla Bartkowski\/Getty Images) <\/figcaption><\/figure>\n<\/p><\/div>\n<\/header>\n<div class=\"single-article__content\">\n<div class=\"single-article__content-inner has-drop-cap\"> <html readability=\"37.063420531985\"><body readability=\"75.664547304171\"><\/p>\n<p>President Donald Trump\u2019s nominee to lead the consumer-focused federal agency that Elon Musk wants to \u201c<a href=\"https:\/\/x.com\/elonmusk\/status\/1861644897490751865\">delete<\/a>\u201d and that Republican lawmakers have <a href=\"https:\/\/www.latimes.com\/business\/hiltzik\/la-fi-mh-cfpb-republicans-20150723-column.html\">railed<\/a> <a href=\"https:\/\/www.nytimes.com\/2016\/03\/17\/business\/dealbook\/house-republicans-clash-with-consumer-protection-unit-chief.html\">against<\/a> <a href=\"https:\/\/financialservices.house.gov\/news\/documentsingle.aspx?DocumentID=402199\">since its<\/a> <a href=\"https:\/\/www.cnn.com\/2017\/11\/25\/news\/wall-street-elizabeth-warren-consumer-financial-protection-bureau\/index.html\">creation<\/a> indicated to senators Thursday that he could continue some data-focused work started by his Democratic predecessor.<\/p>\n<p>In his <a href=\"https:\/\/www.banking.senate.gov\/hearings\/02\/20\/2025\/nomination-hearing\">nomination hearing<\/a> to lead the Consumer Financial Protection Bureau, Jonathan McKernan told members of the Senate Banking Committee that Rohit Chopra \u2014 director of the agency during Joe Biden\u2019s presidency \u2014 \u201cwas onto something\u201d with his policies targeting data brokers and data aggregators.<\/p>\n<p>\u201cThere\u2019s privacy issues here. There\u2019s potentially national security issues here,\u201d said McKernan, who spent the past two years serving on the Federal Deposit Insurance Corp.\u2019s board. \u201cAnd I think it\u2019s important that we \u2014 both in the regulated space and then the rest of our elected officials \u2014 continue to focus on this. As these entities are collecting more and more data and the analytics get more and more powerful, there\u2019s some real policy issues here.\u201d<\/p>\n<p>McKernan commended Chopra\u2019s work \u201cto increase our attention on some of the very significant policy issues posed by data collection.\u201d The CFPB under Chopra <a href=\"https:\/\/www.consumerfinance.gov\/about-us\/newsroom\/cfpb-proposes-rule-to-stop-data-brokers-from-selling-sensitive-personal-data-to-scammers-stalkers-and-spies\/\">introduced a rule in December<\/a> to curb the selling of Americans\u2019 personal and financial information by data brokers, limiting the sale of Social Security numbers, phone numbers and other identifiers collected by certain companies. The rule would classify data brokers as consumer reporting agencies <a href=\"https:\/\/cyberscoop.com\/cfpb-data-broker-regulation-fcra-privacy-protection\/\">under the Fair Credit Reporting Act<\/a>, holding them accountable to various accuracy and compliance standards.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>Chopra spoke often during his time leading the agency about the <a href=\"https:\/\/www.consumerfinance.gov\/about-us\/newsroom\/prepared-opening-remarks-of-cfpb-director-rohit-chopra-at-the-aspen-institute-on-abuse-and-misuse-of-our-personal-data\/\">misuse of personal data<\/a>, framing data protection as <a href=\"https:\/\/www.consumerfinance.gov\/about-us\/newsroom\/prepared-remarks-of-cfpb-director-rohit-chopra-at-the-white-house-on-data-protection-and-national-security\/\">a matter of national security<\/a>. Many industry groups, meanwhile, <a href=\"https:\/\/cyberscoop.com\/proposed-data-broker-regulations-draw-industry-pushback-on-anonymized-data-exceptions-bulk-thresholds\/\">came out against<\/a> proposed Biden administration rules on data brokers, particularly one that banned the selling of bulk sensitive information to adversarial foreign entities.<\/p>\n<p>Despite that pushback, McKernan appeared committed Thursday to continuing that work and focusing on some internal data security. He told Sen. Catherine Cortez Masto, D-Nev., that he would implement a policy to protect the security of confidential information the CFPB obtains from the public and from the companies it supervises. <\/p>\n<p>McKernan also said he intends to \u201ctake a close look\u201d at information the CFPB has on its servers \u201cand whether that\u2019s really necessary.\u201d<\/p>\n<p>\u201cThere\u2019s been a lot of focus on this issue,\u201d he added. \u201cI think we need to be focused on both risk, external and internal. We also should be thinking about the risk that China or another adversary gets ahold of that information.\u201d<\/p>\n<p>Thursday\u2019s hearing came just weeks after Office of Management and Budget Director <a href=\"https:\/\/fedscoop.com\/russell-vought-confirmed-omb-director-senate\/\">Russell Vought<\/a> ordered the CFPB to <a href=\"https:\/\/apnews.com\/article\/trump-consumer-protection-cease-1b93c60a773b6b5ee629e769ae6850e9\">stop nearly all its work<\/a>, leading several Democratic lawmakers to question McKernan about what he\u2019d actually be able to do in the role.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>Sen. Elizabeth Warren, D-Mass., ranking member of the committee and the <a href=\"https:\/\/democracyjournal.org\/magazine\/5\/unsafe-at-any-rate\/\">brains behind the CFPB\u2019s creation<\/a>, told McKernan that \u201cit kind of feels like you\u2019ve been lined up to be the number one horse at the glue factory.\u201d<\/p>\n<p>McKernan, a Duke Law grad who previously served in counsel and advisory roles with the Treasury Department, the Federal Housing Finance Agency and to former Republican Sens.
