David Ake\/Getty Images) <\/figcaption><\/figure>\n<\/p><\/div>\n<\/header>\n<div class=\"single-article__content\">\n<div class=\"single-article__content-inner has-drop-cap\"> <html readability=\"54.331291979455\"><body readability=\"110.67348242812\"><\/p>\n<p>A federal appeals court overruled a district court judge\u2019s sentence for Capital One hacker <a href=\"https:\/\/cyberscoop.com\/tag\/paige-thompson\/\">Paige Thompson<\/a> this week, deciding that the sentence of five years\u2019 probation plus time served was too lenient.<\/p>\n<p>Describing the hack as the \u201csecond largest data breach in the United States at the time, causing tens of millions of dollars in damage and emotional and reputational harm to numerous individuals and entities,\u201d two of three judges from the 9th Circuit Court of Appeals said they believed that <a href=\"https:\/\/www.seattletimes.com\/business\/no-prison-for-seattle-hacker-behind-capital-one-250m-data-breach\/\">the sentence<\/a> was \u201csubstantially unreasonable.\u201d<\/p>\n<p>In deciding on the original sentence in 2022, U.S. District Judge Robert Lasnik considered that Thompson was transgender, autistic and had suffered past trauma. He raised the prospect of Bureau of Prisons decisions under a future presidential administration making life more difficult for transgender inmates. He also noted that the hack wasn\u2019t done in a \u201cmalicious manner\u201d and that Thompson was \u201ctormented\u201d about her activities.<\/p>\n<p>Thompson <a href=\"https:\/\/cyberscoop.com\/paige-thompson-capital-one-30-companies\/\">was charged with stealing data<\/a> on 106 million Capital One customers after taking advantage of a misconfigured firewall in the bank\u2019s <a href=\"https:\/\/cyberscoop.com\/tag\/cloud-security\/\">cloud computing system<\/a>. Over the course of the investigation, the government found terabytes of additional data Thompson took from more than 30 organizations.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>Prosecutors swiftly appealed the sentence, with then-<a href=\"https:\/\/www.justice.gov\/usao-wdwa\/pr\/former-hacker-sentenced-stealing-computer-power-mine-cryptocurrency-and-stealing\">U.S. Attorney Nick Brown saying<\/a> \u201cthis is not what justice looks like.\u201d They argued that the judge gave too much weight to Thompson\u2019s history and personal characteristics.<\/p>\n<p>\u201cWe agree that the district court overemphasized Thompson\u2019s personal story,\u201d <a href=\"https:\/\/cdn.ca9.uscourts.gov\/datastore\/opinions\/2025\/03\/17\/22-30179.pdf\">Judge Danielle Forrest wrote<\/a>, with Judge Johnnie Rawlinson concurring. \u201cThompson\u2019s personal background and characteristics are, of course, proper considerations at sentencing, but they may not be the sole basis for the chosen sentence.\u201d<\/p>\n<p>The ruling also disputed the district judge saying the hack wasn\u2019t malicious, or that Thompson was tortured over her behavior. Thompson, a former Amazon Web Services software engineer, blamed victims\u2019 incompetence for the theft and encouraged others to hack them, and she also bragged about what she did, the ruling states.<\/p>\n<p>Therefore, with a maximum sentence of 210 months, the sentence was too lenient, it reads.<\/p>\n<p>President Donald Trump appointed Forrest. President Bill Clinton appointed Rawlinson. The third appeals court judge, Jennifer Sung, appointed by President Joe Biden, took issue with the duo\u2019s decision.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>What matters most is whether the district judge engaged in \u201cabuse of discretion,\u201d such as a procedural error, and there\u2019s no sign of that in the Thompson sentence, Sung wrote.<\/p>\n<p>The full quote on Lasnick\u2019s \u201cmalicious manner\u201d comment sheds more favorable light on the judge\u2019s viewpoint, Sung observed. Lasnik said did not act \u201cin the malicious manner that you want to punish, to the same degree as somebody who gets that information and immediately turns to monetizing it in some way,\u201d Sung noted. Thompson also showed signs of being tormented over her activities, openly seeking jail or death.<\/p>\n<p>While the majority said prospective future administrations\u2019 actions on transgender inmates shouldn\u2019t play a role in sentencing, Sung said the district court correctly noted that it was&nbsp; \u200b\u200b\u201cdealing with Paige Thompson, what she did, who she is, is the dilemma before the court today,\u201d and therefore the sentence gave proper weight to her being transgender.<\/p>\n<p>The Center for Cybersecurity Policy and Law, in a friend of the court brief in support of the government appeal, said it wouldn\u2019t give its opinion on how long Thompson\u2019s sentence should be. But it asked the court to clarify one element in its ruling.<\/p>\n<p>\u201cIt is critical for legal frameworks to maintain the distinction between good-faith security research and harmful criminal activities,\u201d it wrote in its brief. \u201cThe Center is interested in this proceeding because a perception that the sentencing at issue was based on the Defense\u2019s arguments in the District Court that the charged conduct was good-faith security research risks eroding the distinction between good-faith security research and harmful criminal activity.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>\u201cAddressing this distinction is needed to ensure ethical research is not conflated with actions like the Defendant\u2019s and thus prevent undermining trust between the security, business, and policy communities,\u201d it continued.<\/p>\n<p>The appeals court ruling made no mention of good-faith security research.<\/p>\n<p>Mo Hamoudi, an attorney for Thompson, did not immediately respond to requests for comment.<\/p>\n<p>The case is being sent back to the district court level for resentencing.<\/p>\n<p><\/body> <\/p>\n<footer class=\"single-article__footer\">\n<div class=\"author-card\" readability=\"7.7216117216117\">\n<div class=\"author-card__avatar\">\n<figure class=\"author-card__image-wrap\"> <img data-recalc-dims=\"1\" decoding=\"async\" class=\"author-card__image\" src=\"https:\/\/i0.wp.com\/ddi.mohflo.net\/wp-content\/uploads\/2025\/03\/capital-one-hacker-paige-thompson-got-too-light-a-sentence-appeals-court-rules-1.jpg?w=640&#038;ssl=1\" alt=\"Tim Starks\"> <\/figure>\n<\/p><\/div>\n<div class=\"author-card__details\" readability=\"10.901098901099\">\n<h4 class=\"author-card__name\">Written by Tim Starks<\/h4>\n<p> Tim Starks is senior reporter at CyberScoop.
