(Photo by Kayla Bartkowski\/Getty Images) <\/figcaption><\/figure>\n<\/p><\/div>\n<\/header>\n<div class=\"single-article__content\">\n<div class=\"single-article__content-inner has-drop-cap\"> <html readability=\"49.85316644872\"><body readability=\"101.1644295302\"><\/p>\n<p>President Donald Trump\u2019s <a href=\"https:\/\/apnews.com\/article\/copyright-director-firing-government-trump-7ab99992a96131bce7de853b66feec68\">firing over the weekend of Shira Perlmutter<\/a>, director of the U.S. Copyright Office, has drawn strong criticism from Democrats and tech experts who believe her dismissal is related to a report on generative AI and copyright law that the register of copyrights released a day earlier.<\/p>\n<p>That <a href=\"https:\/\/www.copyright.gov\/ai\/Copyright-and-Artificial-Intelligence-Part-3-Generative-AI-Training-Report-Pre-Publication-Version.pdf#page111\">report<\/a>, overseen by Perlmutter, questioned whether AI companies can legally train their models on massive amounts of copyrighted data without compensating creators. It also disputed the common claim made by AI companies that this practice <a href=\"https:\/\/www.forbes.com\/sites\/roomykhan\/2024\/10\/04\/ai-training-data-dilemma-legal-experts-argue-for-fair-use\/\">should fall under<\/a> the \u201cFair Use\u201d exemption of copyright law. <\/p>\n<p>While the U.S. Copyright Office noted that data collection might sometimes be legal, it sees important differences between academic or nonprofit use and what commercial AI companies are doing.<\/p>\n<p>\u201cWhen a model is deployed for purposes such as analysis or research \u2014 the types of uses that are critical to international competitiveness \u2014 the outputs are unlikely to substitute for expressive works used in training,\u201d the report stated. \u201cBut making commercial use of vast troves of copyrighted works to produce expressive content that competes with them in existing markets, especially where this is accomplished through illegal access, goes beyond established fair use boundaries.\u201d<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>The report identified two aspects of AI training that may conflict with existing copyright law: early training phases and memorization.<\/p>\n<p>Large language models are trained in iterative steps, ingesting massive amounts of data while developers tweak the system weights to make the model\u2019s answers more responsive and useful. <\/p>\n<p>This phase, called \u201cpre-training,\u201d is what AI companies argue should be permitted. But the Copyright Office noted that such pre-training \u201coften requires orders of magnitude more data and computing power than other training\u201d and is the stage \u201cresponsible for many of the sophisticated capabilities of generative AI models.\u201d<\/p>\n<p>\u201cThe steps required to produce a training dataset containing copyrighted works clearly implicate the right of reproduction,\u201d the report concluded, while also adding that creating and deploying an AI system with copyrighted material \u201cinvolves multiple acts that, absent a license or other defense, may infringe one or more rights\u201d of copyright holders.<\/p>\n<p>Businesses like OpenAI, Anthropic and Meta <a href=\"https:\/\/www.theguardian.com\/books\/2025\/apr\/04\/us-authors-copyright-lawsuits-against-openai-and-microsoft-combined-in-new-york-with-newspaper-actions\">are the subject<\/a> of <a href=\"https:\/\/www.publishersweekly.com\/pw\/by-topic\/industry-news\/publisher-news\/article\/95768-authors-sue-ai-firm-anthropic-for-copyright-infringement.html\">numerous lawsuits<\/a> from news organizations, entertainers, artists and creators accusing them of <a href=\"https:\/\/www.reuters.com\/legal\/litigation\/meta-says-copying-books-was-fair-use-authors-ai-lawsuit-2025-03-25\/\">mass intellectual property theft<\/a> by collecting data from the internet, social media,data brokers and other sources. At the same time, OpenAI has objected to Chinese companies like High Flyer training their own AI models on data from ChatGPT and other U.S.-made AI tools.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>The report also took issue with claims from AI companies that they cannot be infringing on copyright because, as lawyers for Google claimed in court, there \u201cis no copy of the training data \u2014 whether text, images, or other formats \u2014 present in the model itself.\u201d OpenAI has called the critique that their models contain copyrighted work \u2014 as opposed to being generally informed by such work in their outputs \u2014 \u201ca common and unfortunate misperception of the technology.\u201d<\/p>\n<p>But again, the Copyright Office disputed those arguments, saying researchers and media outlets have identified numerous instances where an AI model generates answers that closely mirror or repeat verbatim protected work.<\/p>\n<p>Those conclusions drew sharp reactions from some industry groups that are pushing the Trump administration for looser restrictions on the data that AI companies can legally collect and use.<\/p>\n<p>\u201cCopyright\u2019s constitutional purpose is to promote progress, yet by this report\u2019s logic legacy content industries could thwart development of generative AI and its revolutionary capabilities,\u201d Adam Eisgrau, senior director of AI, creativity & copyright policy for the Chamber of Progress, said in a statement. \u201cThankfully, fair use is independently decided by judges on a case-by-case basis and not the Copyright Office.\u201d<\/p>\n<p>Rep.
