(Photo by Jemal Countess\/Getty Images for MoveOn) <\/figcaption><\/figure>\n<\/p><\/div>\n<\/header>\n<div class=\"single-article__content\">\n<div class=\"single-article__content-inner has-drop-cap\"> <html readability=\"57.474010102656\"><body readability=\"116.03383120389\"><\/p>\n<p>The Consumer Financial Protection Bureau is set to withdraw a Biden-era rule aimed at cracking down on data brokers and their selling of Americans\u2019 personal and financial information.<\/p>\n<p>In a <a href=\"https:\/\/public-inspection.federalregister.gov\/2025-08644.pdf\">notice set to publish<\/a> Thursday in the Federal Register, the CFPB said legislative rulemaking on the data broker industry \u201cis not necessary or appropriate at this time,\u201d and the agency does not plan to \u201ctake any further action\u201d on the proposal. The notice was issued by <a href=\"https:\/\/fedscoop.com\/tag\/russell-vought\/\">Russell Vought<\/a>, acting director of the agency, head of the Office of Management and Budget and a <a href=\"https:\/\/apnews.com\/article\/trump-doge-russell-vought-project-2025-f403174299933b7e3a3b6ebd779c146c\">Project 2025 architect<\/a>.<\/p>\n<p>The withdrawal of the <a href=\"https:\/\/files.consumerfinance.gov\/f\/documents\/cfpb_nprm-protecting-ams-from-harmful-data-broker-practices_2024-12.pdf\">rule<\/a>, which was first reported by <a href=\"https:\/\/www.wired.com\/story\/cfpb-quietly-kills-rule-to-shield-americans-from-data-brokers\/\">Wired<\/a>, comes after President Donald Trump\u2019s initial nominee to lead the CFPB signaled to Congress in February an openness to continuing Biden administration data-broker rules.<\/p>\n<p>Jonathan McKernan, a former Treasury Department and Federal Housing Finance Agency staffer, told the Senate Banking Committee that Rohit Chopra \u2014 President Joe Biden\u2019s CFPB director \u2014 \u201c<a href=\"https:\/\/cyberscoop.com\/cfpb-nominee-jonathan-mckernan-data-brokers\/\">was onto something<\/a>\u201d with his policies targeting data brokers and data aggregators.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>\u201cAnd I think it\u2019s important that we \u2014 both in the regulated space and then the rest of our elected officials \u2014 continue to focus on this,\u201d McKernan, a former Federal Deposit Insurance Corp. board member, said at the time. \u201cAs these entities are collecting more and more data and the analytics get more and more powerful, there\u2019s some real policy issues here.\u201d<\/p>\n<p>Though McKernan\u2019s CFPB nomination advanced out of committee, he never received a full Senate vote and has since been nominated to serve as the Treasury Department\u2019s <a href=\"https:\/\/home.treasury.gov\/news\/press-releases\/sb0137\">undersecretary of domestic finance<\/a>. The New York Times reported last week that McKernan\u2019s CFPB nomination <a href=\"https:\/\/www.nytimes.com\/2025\/05\/09\/us\/politics\/cfpb-jonathan-mckernan-trump.html\">will be dropped<\/a>.<\/p>\n<p>Chopra had introduced the data-broker rule last December, part of an agency effort to limit the sale of Social Security numbers, phone numbers and other identifying information collected by some companies. The rule would have classified data brokers as consumer reporting agencies under the Fair Credit Reporting Act, locking the industry in to certain accuracy and compliance standards.<\/p>\n<p>The CFPB\u2019s withdrawal notice took particular issue with the rule\u2019s focus on the Fair Credit Reporting Act, saying that the proposal was \u201cnot aligned with the Bureau\u2019s current interpretation of the FCRA, which it is in the process of revising.\u201d Other related policy objectives have also changed, the notice stated.<\/p>\n<p>The agency also cited \u201cnumerous concerns\u201d about the rule raised in public comments, specifically regarding the CFPB\u2019s statutory authority and its \u201cpropriety under the plain text of the FCRA.\u201d More than <a href=\"https:\/\/www.regulations.gov\/docket\/CFPB-2024-0044\/comments\">600 comments<\/a> were submitted on the rule.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>\u201cWhen and if the Bureau determines it necessary to issue a rule implementing the relevant definitions and provisions of the FCRA, it will propose a new rule and seek public comment thereon,\u201d the notice said. <\/p>\n<p>Industry groups were largely opposed to any Biden-era rules governing data brokers, especially one that <a href=\"https:\/\/cyberscoop.com\/proposed-data-broker-regulations-draw-industry-pushback-on-anonymized-data-exceptions-bulk-thresholds\/\">barred the selling of bulk sensitive information<\/a> to adversarial foreign entities. Chopra frequently made the case during his time leading the CFPB that the <a href=\"https:\/\/www.consumerfinance.gov\/about-us\/newsroom\/prepared-opening-remarks-of-cfpb-director-rohit-chopra-at-the-aspen-institute-on-abuse-and-misuse-of-our-personal-data\/\">misuse of personal data<\/a> was a <a href=\"https:\/\/www.consumerfinance.gov\/about-us\/newsroom\/prepared-remarks-of-cfpb-director-rohit-chopra-at-the-white-house-on-data-protection-and-national-security\/\">national security issue<\/a>.<\/p>\n<p>Naveed Shah, political director of the veteran-led grassroots group Common Defense, said in a statement that the rule protected Americans\u2019 privacy and personal data \u201cfrom exploitation,\u201d ensuring that data brokers followed the same rules as companies that handle sensitive financial data.<\/p>\n<p>\u201cWithout it, data brokers can continue profiting by selling personal information to unscrupulous actors, including scammers and foreign governments, putting millions at risk,\u201d Shah said. \u201cThe decision prioritizes corporate profits over the safety and security of individuals, including vulnerable groups like servicemembers and veterans.\u201d<\/p>\n<p>Matt Schwartz, policy analyst at Consumer Reports, said in a statement that the decision to drop the data-brokers rule is the latest in a series of Trump administration moves to \u201cabandon the CFPB\u2019s critical mission to protect consumers.\u201d <\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>\u201cData brokers collect a treasure trove of sensitive information about virtually every American and sell that information widely, including to scammers looking to rip off consumers,\u201d Schwartz said. \u201cDropping these proposed limits will leave consumers unprotected and make it more likely that sensitive information like their Social Security numbers will wind up in the hands of crooks.\u201d<\/p>\n<p>Ridhi Shetty, senior policy counsel for the Center for Democracy & Technology\u2019s Privacy & Data Project, echoed those concerns, saying in a statement that the rescission of the rule cuts against the CFPB\u2019s post-financial crisis mission of \u201ctackling companies\u2019 misuse of people\u2019s private data.\u201d<\/p>\n<p>\u201cThe agency\u2019s proposed rule to address data broker practices was a critical step toward reining in an industry that vacuums up and monetizes people\u2019s most personal information,\u201d Shetty said. \u201cRescinding that proposed rule does a disservice to consumers, and exposes them to predatory financial offers, fraud, identity theft, and threats to their personal safety.\u201d<\/p>\n<p>The CFPB under the Trump administration has been targeted early and often, with Vought <a href=\"https:\/\/apnews.com\/article\/trump-consumer-protection-cease-1b93c60a773b6b5ee629e769ae6850e9\">ordering agency staffers to stop their work<\/a> and Elon Musk <a href=\"https:\/\/www.washingtonpost.com\/business\/2025\/02\/07\/cfpb-doge-trump-musk-chopra\/\">dispatching DOGE<\/a> on the bureau while <a href=\"https:\/\/x.com\/elonmusk\/status\/1887979940269666769?lang=en\">calling for its death<\/a>.
