He claimed that supposed censorship stifled the free and unencumbered exchange of ideas essential to democracy, and posed a clear threat to the First Amendment.<\/p>\n<p>\u201cAfter years and years of illegal and unconstitutional federal efforts to restrict free expression, I will sign an executive order to immediately stop all government censorship and bring back free speech to America,\u201d Trump said on Inauguration Day in January.<\/p>\n<p>Now, just four months into Trump\u2019s second term, a commissioner on the Federal Communications Commission is making the case that the president and his administration has been seeking to censor and control content \u201cbefore day one\u201d of his presidency. <\/p>\n<p>Speaking Friday at an event hosted by the Competitive Enterprise Institute, Anna Gomez, one of two Democrat-appointed commissioners on the FCC, <a href=\"https:\/\/www.youtube.com\/live\/RVQcHuSy-w4\">warned<\/a> that the agency has gone far off track in its mission and is becoming a media propaganda enforcer for the Trump administration.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>\u201cThe First Amendment has protected our fundamental right to freely speak and to hold power to account since 1791,\u201d Gomez said. \u201cIt is foundational to our democracy and yet today, the greatest threat to that freedom is coming from our own government.\u201d<\/p>\n<p>Gomez pointed to a range of policy actions taken by the FCC under Trump and new chair Brendan Carr, such as using the agency\u2019s broadcast licensing authorities to chill free speech. She argued that these actions are \u201cantithetical\u201d to the agency\u2019s mission, its legal authority, and the First Amendment.<\/p>\n<p>\u201cThis FCC has made clear that it will go after any news outlet that dares to report the truth, if that truth is unfavorable or inconvenient to this administration,\u201d Gomez said.<\/p>\n<p>Carr, a Republican and vocal critic of the Biden administration\u2019s approach to content moderation, has<a href=\"https:\/\/www.wired.com\/story\/plaintext-fcc-brendan-carr-donald-trump\/\"> launched<\/a> investigations <a href=\"https:\/\/pressfreedomtracker.us\/all-incidents\/brendan-carr-targets-news-outlets-as-chair-of-the-fcc\/\">into news outlets<\/a> over their editorial decisions and <a href=\"https:\/\/www.fcc.gov\/sites\/default\/files\/DOC-407732A1.pdf\">warned tech companies against using<\/a> third-party services like \u201cNewsGuard\u201d that rate news reliability. He has also threatened to remove Section 230 protections from tech companies if, in his view, they don\u2019t moderate political content \u201cin good faith.\u201d<\/p>\n<p>Legal experts have told CyberScoop that these activities all appear to be straightforward examples of speech that\u2019s clearly protected under the First Amendment. In contrast to claims levied by Carr and Trump administration allies, the Supreme Court has largely upheld <a href=\"https:\/\/cyberscoop.com\/supreme-court-netchoice-content-moderation\/\">the freedom of tech companies to moderate<\/a> content and ruled that Biden administration\u2019s <a href=\"https:\/\/cyberscoop.com\/supreme-court-rejects-effort-to-limit-government-communication-on-misinformation\/\">discussions with social media companies<\/a> were within constitutional limits and not coercive.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>Gomez called Carr\u2019s approach \u201cdangerous\u201d and said \u201cunprecedented actions\u201d had been taken \u201cby an independent government regulator.\u201d<\/p>\n<p>It\u2019s not just Gomez or Democrats making that argument, as libertarian news outlets like Reason Magazine have <a href=\"https:\/\/reason.com\/2025\/02\/05\/how-the-fccs-warrior-for-free-speech-became-our-censor-in-chief\/\">referred to Carr<\/a> as \u201cour Censor in Chief\u201d when describing his record under the Trump administration.<\/p>\n<p>Numerous media outlets and whistleblowers confirm Gomez\u2019s account of the FCC under Carr and the broader Trump administration, revealing an obsession with policing language. At many agencies, work has slowed as employees were reassigned to remove any mention of \u201cdiversity\u201d or \u201cequity\u201d from federal materials, even when those phrases were unrelated to the issues.<\/p>\n<p>Meanwhile, the administration has broken with modern precedent to <a href=\"https:\/\/cyberscoop.com\/trump-moves-to-fire-democratic-ftc-commissioners\/\">fire only Democratic members<\/a> of federal agencies, advisory boards and commissions, even from bipartisan bodies like the Federal Trade Commission, the Consumer Product Safety Commission and the Equal Employment Opportunity Commission.<\/p>\n<p>Republicans on the Hill are currently working to confirm Olivia Trusty, a former GOP congressional staffer, as an FCC commissioner. Agency observers worry that once Trusty is confirmed \u2014 and Democratic Commissioner Geoffrey Starks retires this year \u2014 Trump will move to leave only Republicans on the panel. <\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>Gomez made it clear that she would not bend to the administration\u2019s pressure, even if it results in her dismissal.<\/p>\n<p>\u201cI refuse to stay quiet while the government chips away at fundamental rights by weaponizing our regulatory authority,\u201d Gomez said. \u201cThis is how I\u2019m using my voice, and I encourage you to use yours, too.
