(Photo by Anna Moneymaker\/Getty Images) <\/figcaption><\/figure>\n<\/p><\/div>\n<\/header>\n<div class=\"single-article__content\">\n<div class=\"single-article__content-inner has-drop-cap\"> <html readability=\"33.495667870036\"><body readability=\"70.109302956333\"><\/p>\n<p>The Securities and Exchange Commission is pulling back cybersecurity regulations for investment companies and investment advisers proposed under the Biden administration.<\/p>\n<p><a href=\"https:\/\/www.sec.gov\/rules-regulations\/2025\/06\/cybersecurity-risk-management-investment-advisers-registered-investment-companies-business\">In a notice<\/a> last week, the SEC said it was withdrawing pending rules requiring those companies and advisers to develop written policies to address cybersecurity risks and report significant cybersecurity incidents to the commission. It also would have required them to report on the last two fiscal years\u2019 cyber incidents and risks in a publicly available registration form.<\/p>\n<p>It\u2019s part of broader deregulation at the SEC under President Donald Trump, with the commission simultaneously <a href=\"https:\/\/www.financial-planning.com\/news\/sec-withdraws-ai-cybersecurity-rules-for-advisors\">dropping proposed rules<\/a> on things like artificial intelligence use and outsourcing. It also comes as industry groups are urging the SEC to <a href=\"https:\/\/www.sifma.org\/resources\/submissions\/letters\/petition-for-rulemaking-on-the-cybersecurity-risk-management-strategy-governance-and-incident-disclosure-rule-joint-trades\/#identifier_8_934230\">reel back in a rule<\/a> that\u2019s the source of even greater animosity for them: one that established regulations requiring swift public disclosure of major cybersecurity incidents.<\/p>\n<p>When the SEC first proposed the now-withdrawn rule in 2022, then-Chairman Gary Gensler touted it as an important safeguard for investment advisers and business development companies.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>\u201cThe proposed rules and amendments are designed to enhance cybersecurity preparedness and could improve investor confidence in the resiliency of advisers and funds against cybersecurity threats and attacks,\u201d <a href=\"https:\/\/www.sec.gov\/newsroom\/press-releases\/2022-20\">Gensler said<\/a>.<\/p>\n<p>In 2023, the commission <a href=\"https:\/\/www.sec.gov\/newsroom\/press-releases\/2023-54\">re-opened the public comment period<\/a> on the rule, saying that it \u201cwill allow interested persons additional time to analyze the issues and prepare comments in light of other regulatory developments, including whether there would be any effects of other Commission proposals related to cybersecurity risk management and disclosure that the Commission should consider.\u201c<\/p>\n<p>At least two large companies that serve as investment advisers, <a href=\"https:\/\/news.bloomberglaw.com\/privacy-and-data-security\/fidelity-investments-slapped-with-suit-over-hacked-client-data\">Fidelity Investments<\/a> and <a href=\"https:\/\/therecord.media\/prudential-breach-revision-exposed-data\">Prudential<\/a>, suffered significant data breaches last year. One advocacy group, Better Markets, pointed to those incidents <a href=\"https:\/\/www.sec.gov\/comments\/s7-04-22\/s70422-534255-1531982.pdf\">in comments<\/a> to the SEC last year.<\/p>\n<p>\u201cThe need for broker-dealers and investment advisers to adopt cybersecurity programs has only become more apparent since the SEC issued the Proposed Rules,\u201d wrote Benjamin Schiffrin, director of securities policy at Better Markets.<\/p>\n<p>But industry groups contended the rule would have done more harm than good.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>\u201cDisclosing detailed information on cyber risks, including past incidents, could help adversaries refine their tactics and techniques to maximize attack impact,\u201d <a href=\"https:\/\/www.sec.gov\/comments\/s7-04-22\/s70422-192339-382882.pdf\">wrote<\/a> Heather Hogsett, senior vice president for BITS at the Bank Policy Institute. \u201cMoreover, the public disclosure of ongoing incidents outlined in several of the Commission\u2019s proposals would impair the ability of other regulators to leverage confidential incident reports and warn other potential victims.
