(Image Credit: Getty Images) <\/figcaption><\/figure>\n<\/p><\/div>\n<\/header>\n<div class=\"single-article__content\">\n<div class=\"single-article__content-inner has-drop-cap\"> <html readability=\"48.039558266029\"><body readability=\"96.567040115649\"><\/p>\n<p>Hundreds of companies registered as data brokers in one U.S. state are not recognized as such in other states with similar disclosure laws, according to a new analysis by the Privacy Rights Clearinghouse and the Electronic Frontier Foundation.<\/p>\n<p>The country has a data broker problem, with few meaningful laws at the federal or state level to curb the mass collection and resale of Americans\u2019 data. These brokers are typically third-party companies that mine the internet, buy customer data from other businesses and otherwise acquire information on hundreds of thousands or millions of Americans with whom they\u2019ve never directly done business.<\/p>\n<p>But before policymakers can rein in the practice, they first must classify the offending companies.<\/p>\n<p>The federal government has no legal definition for what constitutes a data broker, and in that absence states like California, Texas, Oregon and Vermont have passed their own laws requiring data brokers in their state to register and provide further information to the government on their practices.<\/p>\n<p>But an analysis by EFF and the Privacy Rights Clearinghouse identified hundreds of companies that are registered as data brokers in one of those states but aren\u2019t listed as such in the other three.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>And those figures likely only scratch the surface of the gap, as there are likely numerous \u201cshady\u201d companies that don\u2019t take steps to register in any states.<\/p>\n<p>\u201cThis analysis only includes companies that registered in at least one state. It does not capture data brokers that completely disregard state laws by failing to register in any state,\u201d wrote authors Mario Trujillo and Haley Tsukayama. \u201cA total of 750 data brokers have registered in at least one state. While harder to find, shady data brokers who have failed to register anywhere should remain a primary enforcement target.\u201d<\/p>\n<p>The authors provided a <a href=\"https:\/\/www.eff.org\/document\/appendix-b-databrokerfullregistry2025\">spreadsheet<\/a> detailing hundreds of businesses across the four states, links to their privacy and collection policies, business addresses, opt-out information and points of contact.<\/p>\n<p>The authors aren\u2019t claiming these companies are breaking the law. Some of those discrepancies may stem from the different ways states legally define a data broker.<\/p>\n<p>California<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202320240SB362\"> defines<\/a> the term as any business \u201cthat knowingly collects and sells to third parties the personal information of a consumer with whom the business does not have a direct relationship.\u201d <a href=\"https:\/\/statutes.capitol.texas.gov\/Docs\/BC\/htm\/BC.509.htm\">Texas\u2019<\/a> law includes any business \u201cwhose principal source of revenue is derived from the collecting, processing, or transferring of personal data that the entity did not collect directly from the individual.\u201d Oregon <a href=\"https:\/\/olis.oregonlegislature.gov\/liz\/2023R1\/Downloads\/MeasureDocument\/HB2052\/Enrolled\">law<\/a> covers any business or entity \u201cthat collects and sells or licenses brokered personal data to another person,\u201d while Vermont\u2019s <a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/09\/062\/02446\">covers<\/a> any business that \u201cknowingly collects and sells or licenses to third parties the brokered personal information of a consumer with whom the business does not have a direct relationship.\u201d<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>All four states have numerous and sometimes differing exceptions for certain businesses and circumstances and \u201cthere are variations that could require a company to register in one state and not another.\u201d<\/p>\n<p>\u201cTo take one example, a data broker registered in Texas that only brokers the data of Texas residents would not be legally required to register in California,\u201d the authors wrote. \u201cTo take another, a data broker that registered with Vermont in 2020 that then changed its business model and is no longer a broker, would not be required to register in 2025.\u201d<\/p>\n<p>Instead, the organizations are calling for state investigators to conduct greater scrutiny and oversight of their data broker industries. They sent letters to attorneys general in all four states highlighting the number of unregistered data brokers who may be operating in their state without disclosure.<\/p>\n<p>\u201cOur analysis is based on a straightforward premise: data brokers that self-identify as such by registering in other states \u2014 or those who registered in any state in previous years \u2014 may have obligations to register in California if they meet the statutory definition of a data broker under California law,\u201d the authors and Privacy Rights Clearinghouse\u2019s Emory Roane <a href=\"https:\/\/www.eff.org\/document\/california-data-broker-registration-letter\">wrote<\/a> to California Attorney General Rob Bonta on Tuesday.<\/p>\n<p>Data privacy experts say that simply registering data brokers won\u2019t reduce their appetite for consumer data on its own, but identifying and classifying who does and doesn\u2019t fall under that definition is a crucial first step to any follow-up legal or policy actions to stem the practice.<\/p>\n<p>Last year, privacy expert Justin Sherman <a href=\"https:\/\/cyberscoop.com\/congressional-privacy-bill-looks-to-rein-in-data-brokers\/\">told CyberScoop<\/a> that while the lack of clarity around who is and isn\u2019t considered a broker is a problem for policymakers, it\u2019s insufficient to meaningfully crack down on a practice that has broadly compromised the personal information of most Americans.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>\u201cMaking transparency and self-regulation the biggest focal points are data broker lobbying strategies to keep the burden on consumers,\u201d Sherman said.&nbsp;Congress attempted to <a href=\"https:\/\/cyberscoop.com\/federal-privacy-bill-passes-house-subcommittee\/\">push data privacy legislation<\/a> last year that would have set up a national registry for data brokers, but the effort broke down among infighting and failed to get a vote.
