Ron Wyden on Monday urged Supreme Court Chief Justice John Roberts to seek an independent review of federal court cybersecurity following the latest major hack, accusing the judiciary of \u201cincompetence\u201d and \u201ccovering up\u201d its \u201cnegligence\u201d over digital defenses.<\/p>\n<p>Wyden, D-Ore., wrote his letter in response to news this month that hackers had reportedly <a href=\"https:\/\/www.politico.com\/news\/2025\/08\/06\/federal-court-filing-system-pacer-hack-00496916\">breached and stolen sealed case data<\/a> from federal district courts dating back to at least July, <a href=\"https:\/\/www.politico.com\/news\/2025\/08\/12\/federal-courts-hack-security-flaw-00506392\">exploiting vulnerabilities<\/a> left unfixed for five years. <a href=\"https:\/\/www.nytimes.com\/2025\/08\/12\/us\/politics\/russia-hack-federal-court-system.html\">Alleged Russian hackers<\/a> were behind both the attack and another past major intrusion, and may have <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2025-08-14\/russian-hackers-lurked-in-us-courts-for-years-took-sealed-files\">lurked in the systems for years<\/a>.<\/p>\n<p>\u201cThe federal judiciary\u2019s current approach to information technology is a severe threat to our national security,\u201d <a href=\"https:\/\/www.wyden.senate.gov\/imo\/media\/doc\/wyden_letter_to_scotus_on_us_courts_hackpdf.pdf\">Wyden said<\/a>. \u201cThe courts have been entrusted with some of our nation\u2019s most confidential and sensitive information, including national security documents that could reveal sources and methods to our adversaries, and sealed criminal charging and investigative documents that could enable suspects to flee from justice or target witnesses. Yet, you continue to refuse to require the federal courts to meet mandatory cybersecurity requirements and allow them to routinely ignore basic cybersecurity best practices.\u201d<\/p>\n<p>That, Wyden said, means someone from the outside must conduct a review, naming the National Academy of Sciences as the organization Roberts should choose.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>The Administrative Office of the U.S. Courts <a href=\"https:\/\/fedscoop.com\/federal-courts-ramp-up-filing-system-security-after-recent-escalated-cyberattacks\/\">said on Aug. 7<\/a> that it was taking steps to improve cybersecurity \u201cin response to recent escalated cyberattacks of a sophisticated and persistent nature on its case management system,\u201d but was vague about specific changes. In that statement the office touted its collaboration with Congress and federal agencies about cyber defenses.<\/p>\n<p>But Wyden said in his letter the judiciary \u201cstonewalls\u201d congressional oversight.
