(Photo by Shuran Huang for The Washington Post via Getty Images) <\/figcaption><\/figure>\n<\/p><\/div>\n<\/header>\n<div class=\"single-article__content\">\n<div class=\"single-article__content-inner has-drop-cap\"> <html readability=\"60.833333333333\"><body readability=\"122.75076569678\"><\/p>\n<p>For the second time, a court has ruled that President Donald Trump\u2019s attempted firing of Federal Trade Commission members Rebecca Slaughter and Alvaro Bedoya was illegal and ordered the agency to reinstate the commissioners.<\/p>\n<p>By law, the FTC governs by a bipartisan 3-2 split, with the president\u2019s party getting an extra seat and controlling the chair. But earlier this year, Trump<a href=\"https:\/\/cyberscoop.com\/trump-moves-to-fire-democratic-ftc-commissioners\/\"> attempted to fire<\/a> just Bedoya and Slaughter, leaving only Republican-appointed members on the commission.<\/p>\n<p>A district court temporarily reinstated Slaughter but that decision was reversed in another court ruling just days later. Bedoya eventually resigned his position, citing financial difficulties.&nbsp;<\/p>\n<p>Now, the District Court of Appeals for the District of Columbia has ruled 2-1 that the attempted firings ran afoul of the law, this time saying the government was likely to lose its case on the merits.&nbsp;<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>In their <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cadc.42226\/gov.uscourts.cadc.42226.01208772020.0_2.pdf\">opinion<\/a>, Judges Cornelia Pillard and Patricia Millett specifically cited the precedent set by the Supreme Court in <a href=\"https:\/\/www.oyez.org\/cases\/1900-1940\/295us602\">Humphrey\u2019s Executor v. United States<\/a>, a 1935 case in which justices unanimously ruled that FTC commissioners could only be fired for specific cause.<\/p>\n<p>That precedent, the judges wrote, remains the law of the land until the Supreme Court says otherwise.&nbsp;&nbsp;<\/p>\n<p>\u201cThe government has no likelihood of success on appeal given controlling and directly on point Supreme Court precedent,\u201d Pillard and Millett wrote. \u201cSpecifically, ninety years ago, a unanimous Supreme Court upheld the constitutionality of the Federal Trade Commission Act\u2019s for-cause removal protection for Federal Trade Commissioners.\u201d<\/p>\n<p>After Trump\u2019s attempted firings in March, Slaughter and Bedoya <a href=\"https:\/\/cyberscoop.com\/bedoya-slaughter-ftc-lawsuit-unlawful-dismissal-trump\/\">quickly challenged<\/a> the legality of the move in court, saying they were fired \u201cnot because they were inefficient, neglectful of their duties, or engaged in malfeasance, but simply because their \u2018continued service on the FTC is\u2019 supposedly \u2018inconsistent with [his] Administration\u2019s priorities.\u2019\u201d<\/p>\n<p>While Humphrey\u2019s Executor remains the law of the land, the administration and some former officials have argued that the FTC now plays a far more important policy role in the executive branch than it did in 1935, when the court cited the \u201cquasi-legislative\u201d and \u201cquasi-judicial\u201d functions of the agency.<\/p>\n<p>The current Supreme Court, they argue, does not share the same views, pointing to a <a href=\"https:\/\/www.supremecourt.gov\/opinions\/19pdf\/19-7_n6io.pdf\">2020 case<\/a> where the court majority suggested that the conclusions about the FTC\u2019s role in Humphrey\u2019s Executor \u201chas not withstood the test of time.\u201d<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>\u201cNo administration until now has wanted to push the limits on that but the current administration has made clear they think it\u2019s wrongly decided,\u201d one former FTC official, who requested anonymity to speak candidly, told CyberScoop in March.<\/p>\n<p>The DC District Court of Appeals said the government \u201cacknowledges that Humphrey\u2019s Executor \u2018remains binding on this Court\u2019\u201d but argues that the court should disregard that precedent.\u201d<\/p>\n<p>\u201cOver the ensuing decades \u2014 and fully informed of the substantial executive power exercised by the Commission \u2014 the Supreme Court has repeatedly and expressly left Humphrey\u2019s Executor in place, and so precluded Presidents from removing Commissioners at will,\u201d Pillard and Millett wrote.<\/p>\n<p>Millett and Pillard argued that the FTC in 1935 had the same core authorities and mission as it does today: to promulgate rules and regulations, investigate violations of federal law, issue subpoenas and enforce violations.<\/p>\n<p>The \u201cpresent-day Commission exercises the same powers that the Court understood it to have in 1935 when Humphrey\u2019s Executor was decided,\u201d they added, and \u201cbucking such precedent is not within this court\u2019s job description.\u201d<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>The D.C. District Court likely won\u2019t have the last word. The administration continues to appeal and most observers expect the matter to ultimately reach the Supreme Court. In the meantime, Slaughter said she intends to return to her job this week.<\/p>\n<p>\u201cAmid the efforts by the Trump admin to illegally abolish independent agencies, [including] the Federal Reserve, I\u2019m glad the court has recognized that he is not above the law,\u201d Slaughter <a href=\"https:\/\/x.com\/RKSlaughterFTC\/status\/1963016538493223215\">wrote<\/a> on X Tuesday after the decision. \u201cI\u2019m eager to get back first thing tomorrow to the work I was entrusted to do on behalf of the American people.\u201d<\/p>\n<p>In a dissent, Judge Neomi Rao referred to the FTC as a \u201cso-called independent agency\u201d and disagreed with the court majority, saying she believed the government would ultimately prevail on the merits.<\/p>\n<p>The circuit court \u201cneed not definitively determine whether Slaughter\u2019s removal was lawful\u201d because in previous cases this year where officials fired by the president were reinstated by courts, the Supreme Court has intervened on the administration\u2019s behalf \u2014 at least while the cases are winding through the court system.<\/p>\n<p>By forcing FTC staff to ignore the president\u2019s directive and treat Slaughter as commissioner in good standing, the district court\u2019s decision \u201cdirectly interferes with the President\u2019s supervision of the Executive Branch and therefore goes beyond the power of the federal courts,\u201d Rao wrote.<\/p>\n<p><\/body> <\/p>\n<footer class=\"single-article__footer\" readability=\"3.5636363636364\">\n<div class=\"author-card\" readability=\"13\">\n<div class=\"author-card__avatar\">\n<figure class=\"author-card__image-wrap\"> <img data-recalc-dims=\"1\" decoding=\"async\" class=\"author-card__image\" src=\"https:\/\/i0.wp.com\/ddi.mohflo.net\/wp-content\/uploads\/2025\/09\/court-rules-fired-ftc-commissioners-be-reinstated-again-1.jpg?w=640&#038;ssl=1\" alt=\"Derek B.
