(CyberScoop) <\/figcaption><\/figure>\n<\/p><\/div>\n<\/header>\n<div class=\"single-article__content\">\n<div class=\"single-article__content-inner has-drop-cap\"> <html readability=\"31.626775147929\"><body readability=\"63.096174096174\"><\/p>\n<p>A man who pleaded guilty in 2023 for charges related to his work as founder and operator of the notorious BreachForums website <a href=\"https:\/\/www.justice.gov\/opa\/pr\/founder-one-worlds-largest-hacker-forums-resentenced-three-years-prison\">was resentenced Tuesday<\/a> to three years in prison after having his initial sentence overturned in January.<\/p>\n<p>Conor Brian Fitzpatrick, 22, operated BreachForums \u2014 once regarded as the largest English-language cybercrime marketplace \u2014 under the alias \u201cPompompurin.\u201d The forum allowed users to purchase, sell, and exchange hacked or stolen data and other illicit materials, including child sexual abuse material, federal authorities said. <\/p>\n<p>Fitzpatrick pleaded guilty in July 2023 to conspiracy to commit access device fraud, solicitation concerning fraudulent access devices, and possession of child sexual abuse material. Prosecutors from the Eastern District of Virginia originally sought nearly 16 years of imprisonment for the defendant. However, Fitzpatrick was <a href=\"https:\/\/cyberscoop.com\/jailed-breachforums-creator-admin-sentenced-to-20-years-of-supervised-release\/\">initially given a sentence<\/a> of 17 days \u2014 time served \u2014 along with 20 years of supervised release.<\/p>\n<p>Court records reveal that the lenient sentence considered mitigating circumstances, including Fitzpatrick\u2019s autism diagnosis and his youth. The sentencing memo noted that even while legal proceedings were ongoing, Fitzpatrick violated the court\u2019s terms by using a VPN to access online chatrooms via Discord. In those environments, he challenged the legitimacy of his guilty plea, expressed regret over not contesting the charges, and made statements trivializing the sale of sensitive data to foreign interests.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>Reaction to these post-plea actions was swift from prosecutors, who appealed the sentence. U.S. Court of Appeals Judge Paul V. Niemeyer, writing the opinion to vacate the original sentence, described Fitzpatrick\u2019s behavior as demonstrating \u201ca lack of remorse,\u201d noting that the district court \u201cnever addressed the seriousness of his crimes or explained how its sentence fulfilled\u201d the legal requirements.<\/p>\n<p>With the appellate court\u2019s decision, <a href=\"https:\/\/cyberscoop.com\/conor-fitzpatrick-resentenced-pompompurin-breachforums\/\">the case was returned for resentencing<\/a>. In addition to the prison sentence, Fitzpatrick was ordered to forfeit over 100 domain names used in connection with BreachForums, more than a dozen electronic devices, and cryptocurrency proceeds from the site\u2019s activity.<\/p>\n<p>BreachForums rose to prominence quickly after law enforcement dismantled RaidForums, then the major English-language hacking platform, in February 2022.
