(Photo by Ryan Murphy\/Getty Images) <\/figcaption><\/figure>\n<\/p><\/div>\n<\/header>\n<div class=\"single-article__content\">\n<div class=\"single-article__content-inner has-drop-cap\"> <html readability=\"26.588533417802\"><body readability=\"56.803001876173\"><\/p>\n<p>Immigration and Customs Enforcement has confirmed it is using Paragon spyware, prompting outrage Thursday from a trio of House Democrats.<\/p>\n<p>In response to a <a href=\"https:\/\/cyberscoop.com\/house-dems-seek-info-about-ice-spyware-contract-wary-of-potential-abuses\/\">letter from the lawmakers<\/a> inquiring about Paragon\u2019s use, acting ICE Director Todd Lyons wrote that he had authorized the use of \u201ccutting-edge technological tools\u201d to help the Homeland Security Investigations division fight fentanyl, particularly against organizations using encrypted communications. <\/p>\n<p>\u201cAny use of the technology will comply with constitutional requirements and be coordinated with the ICE Office of the Principal Legal Advisor,\u201d Lyons wrote Wednesday, without naming Paragon specifically. \u201cFurther, use of the technology will align with and support the Homeland Security Task Force\u2019s strategic initiatives to identify, disrupt, and dismantle Foreign Terrorist Organizations, addressing the escalating fentanyl epidemic and safeguarding national security.\u201d<\/p>\n<p>But Democratic Reps. Summer Lee of Pennsylvania, Shontel Brown of Ohio and Yassamin Ansari of Arizona weren\u2019t pleased with ICE\u2019s answer.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>\u201cIt\u2019s outrageous that [the Department of Homeland Security] and ICE are using this spyware with no Congressional oversight and a complete lack of compliance standards,\u201d they said in a joint statement shared with CyberScoop. \u201cGiven the track record of the Trump Administration, ICE\u2019s feigned compliance with existing standards doesn\u2019t mean much; we need to see proof and evidence of ironclad safeguards.<\/p>\n<p>\u201cThat\u2019s why we requested so much documentation, which they have completely failed to provide,\u201d they continued. \u201cHouse Democrats will continue to demand more information and hold ICE accountable for its abuses.\u201d<\/p>\n<p>Lyons wrote that he certified use of the technology, which he said complied with a 2023 executive order issued by then-President Joe Biden. That executive order requires certification that use of commercial spyware wouldn\u2019t pose national security or counterintelligence risks, or create significant risks of improper use by a foreign government.<\/p>\n<p>In 2024, the $2 million ICE contract with Paragon came under White House review. But last year, ICE <a href=\"https:\/\/jackpoulson.substack.com\/p\/exclusive-ice-has-reactivated-its\">lifted a stop-work order<\/a>.<\/p>\n<p>ICE didn\u2019t immediately respond to a request for comment on the Democrats\u2019 reaction. ICE\u2019s use of surveillance technology has <a href=\"https:\/\/fedscoop.com\/dhs-surveillance-technology-ai-funding-document-spyware\/\">drawn concern<\/a> from civil liberties groups.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>Paragon\u2019s Graphite technology has been found on <a href=\"https:\/\/cyberscoop.com\/paragon-spyware-citizen-lab-italy-journalists\/\">the phones of journalists<\/a> and there are suspected uses in <a href=\"https:\/\/cyberscoop.com\/six-countries-suspected-paragon-spyware-customers\/\">a number of countries<\/a>.
