(Photo by ANDREAS SOLARO \/ AFP) (Photo by ANDREAS SOLARO\/AFP via Getty Images) <\/figcaption><\/figure>\n<\/p><\/div>\n<\/header>\n<div class=\"single-article__content\">\n<div class=\"single-article__content-inner has-drop-cap\"> <html readability=\"61.208556149733\"><body readability=\"126.62765764129\"><\/p>\n<p>In 2022 and 2023, the European Parliament\u2019s PEGA Committee investigated spyware abuses across the European Union following journalistic revelations about government deployment of NSO Group\u2019s Pegasus technology.<\/p>\n<p>Now, years later, it turns out that someone was using Pegasus spyware on one of the committee\u2019s own. <\/p>\n<p>In <a href=\"https:\/\/citizenlab.ca\/research\/member-of-committee-investigating-spyware-hacked-with-pegasus\/\">a report<\/a> published Friday, the University of Toronto\u2019s Citizen Lab revealed that it found Pegasus on the phone of substitute PEGA Committee member Stelios Kouloglou, a Greek journalist and former member of the European Parliament. It\u2019s the first time a member of the committee has been publicly identified as a Pegasus victim.<\/p>\n<p>For Kouloglou, the Pegasus infection was surprising. For another PEGA Committee member, it was fully expected, if delayed. For Citizen Lab, it was ironic.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>For all of them, it was further evidence that much more needs to be done to prevent spyware abuses \u2014 such as enacting the very recommendations of the PEGA Committee\u2019s <a href=\"https:\/\/www.washingtonpost.com\/politics\/2023\/05\/09\/european-committee-investigating-spyware-abuses-advances-long-awaited-report\/\">final report<\/a> that <a href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/12\/07\/european-spyware-investigative-panel-faces-an-uphill-climb\/\">never saw action<\/a> in the European Parliament.<\/p>\n<p>Kouloglou told CyberScoop that he had run security tests on his phone prior to joining the PEGA committee in 2022, so he didn\u2019t think anyone would be bold enough to try to infect his phone once he became a member. With Greece\u2019s use of Predator spyware under scrutiny, \u201cit would be a big scandal\u201d if he was hacked while on the panel, he said.<\/p>\n<p>But someone \u2014 Citizen Lab\u2019s investigation didn\u2019t uncover whom \u2014 infected Kouloglou\u2019s phone with Pegasus twice, once around October of 2022 and once around March of 2023, investigators concluded with \u201chigh confidence.\u201d<\/p>\n<p>During the first infection, the committee was preparing for some prominent hearings and the first draft of its report. Kouloglou was in the hospital and got a visit from another Greek journalist who had testified before the committee and had himself had his phone infected with spyware earlier. Given the ability of spyware to listen to audio through an infected phone, it\u2019s possible the infection ran afoul of protections for health data.<\/p>\n<p>During the second infection, the panel was preparing for yet more hearings and \u201cwas engaged in intense discussions related to the final drafting process,\u201d according to Citizen Lab.<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>The Citizen Lab investigation of Kouloglou\u2019s came about this May, after he said a lawyer he knew told him there was a way to send his phone\u2019s data to the research organization, during a time when Kouloglou was doing some investigative reporting and writing a \u201cscandal of the week\u201d column. \u201cI said, \u2018Why not? Let\u2019s do it,\u201d he said.<\/p>\n<p>Whoever was responsible for infecting Kouloglou\u2019s phone did so during \u201ccrucial moments\u201d of the committee\u2019s work, said Hannah Neumann, a member of the PEGA Committee and European Parliament member from Germany.<\/p>\n<p>\u201cMany of us were expecting some hacks during the committee, but it\u2019s still frustrating now to figure out that it really happened,\u201d she told CyberScoop. \u201cWhen we decided to set up the Pega Committee, we really worked hard with our internal European Parliament IT security\u2026 so that they can provide spyware checks for the members of the Pega Committee and their staff.\u201d<\/p>\n<p>Kouloglou and Neumann could only speculate on who was responsible. But for the two of them, and Citizen Lab, the motive seems clear.<\/p>\n<p>\u201cIt is ironic that a member of the committee charged with investigating Pegasus was himself targeted with Pegasus spyware,\u201d Ron Deibert, founder and director of Citizen Lab. \u201cSomeone, somewhere likely wanted to breach parliamentary privilege and find out what was going on in that committee. This case shows how the still unregulated and highly abused mercenary spyware industry is poisonous to democratic processes.\u201d <\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>Kouloglou said he plans to pursue legal action against NSO Group. Many spyware victims have had difficulty <a href=\"https:\/\/cyberscoop.com\/spyware-court-cases-nso-group-meta-whatsapp-apple\/\">winning lawsuits<\/a> against spyware makers, although <a href=\"https:\/\/cyberscoop.com\/meta-contempt-complaint-nso-group-spyware\/\">not all<\/a>.<\/p>\n<p>Israel-based NSO Group did not respond to a request for comment Thursday afternoon.<\/p>\n<p>Neuman said the lessons learned as a result of Kouloglou\u2019s phone infection include, \u201cfor members of national parliament and the European Parliament: Regularly get your devices checked. Apparently they don\u2019t respect European democracy and parliamentarism.\u201d<\/p>\n<p>Most importantly, it\u2019s time to enact the PEGA committee\u2019s recommendations, she said.<\/p>\n<p>\u201cI don\u2019t know how much more it needs for member states and the commission to wake up and actually start implementing the very good recommendations of our PEGA committee, because we all know that there is a spyware abuse,\u201d Neuman said. \u201cI don\u2019t need to have another committee for that. I just need them to act.\u201d<\/p>\n<div class=\"ad ad--inline_1 \">\n<div class=\"ad__inner\"> <span class=\"screen-reader-text\">Advertisement<\/span> <\/div>\n<\/div>\n<p>Kouloglou almost certainly won\u2019t be the last member of parliament to get infected, said John Scott-Railton, senior researcher at Citizen Lab. Some had been infected prior to the work of the PEGA Committee, and some have been found to be targeted since. (The United States\u2019 legislative body has been targeted in the past as well.)<\/p>\n<p>\u201cProviding highly secretive government agencies with surveillance tools supplied by unaccountable and often unethical mercenary firms is a recipe for the abuse of power,\u201d he told CyberScoop. \u201cI can tell you how the next chapter will go: more hacked Parliamentarians.
